Legal and Sociological Analyses on Telework at Home in Brazil  [PDF]

Abstract: This text is a small adaptation of our Master-degree’s dissertation, which had telework performed in Brazilian homes as its main goal. The research as a whole focused on both sociological and legal analyses of the aspects of telework, regarding flexible work schedules, legislation on distance work, hierarchical relationships, space and time organization of work utilizing telematic means, as well as perceptions of the actors involved with this activity. In this paper, the legal aspects of telework in Brazil will be emphasized.

Abstract: in our current context, where "the male breadwinner and the woman caretaker" model that underlies the labor code due to its negative incidence in the materialization of equality of opportunity between female and male workers is being questioned, the development and use of atypical modalities of hiring can create new options to balance gender roles in labor matters. in fact, job-hiring modes, such as telework, may offer solutions that do not mean that women have to postpone their professional fulfillment if they choose maternity and create new opportunities for men to satisfy their growing interest to undertake their paternity in a more active way, disassociating themselves from their traditional role of mere breadwinners. this study attempts to evidence the way in which telework can contribute to create opportunities for the harmonization of work and family in order to contribute to the necessary definiteness of gender equity in the country.

Abstract: Based on the technological progress and the complex work processes of our increasingly globalisedworld, novel ways of organising work can be seen everywhere. The EU has defined atypical forms ofemployment as breakthrough points in improving employment indices.Telework is probably the the most innovative atypical working form, offering huge amount of benefitsfor the employer, employee and the society. Abstract: the goal of the present article is to analyze how the telework had been studied as a new form of labor organization. specifically we emphasized some interpretations of this social phenomenon and the relationship between it and the supposed dislocation of the work force. likewise we studied how the teleworkers has been conceptualized in the context of a precarious labor. also, we observed which are the new labor demands inherent of this kind of work and how those are been expressed inside the industrial relations system. the afore mentioned is done in order to suggest an analysis of the telework much cautious assuming this process like nor lineal and nor univocal.

Abstract: the nature of work, as it has been understood, is undergoing a fundamental redefinition. teleworking and computerized remote work constitute the most important manifestations of that redefinition. as a result of the ict evolution, many of the tasks previously accomplished in the factory or in the office can now be done from home, from telecenters or from any place where the worker can have access to the necessary tools. disable citizens have being considered as potential beneficiares of teleworking. however, the subject raises several questions. specifically, it is important to determine companies' willingness to adopt this new work modality, the activities they will consider to pass to external entities and the more appropriated model to adopt, when talking about teleworkers with special needs. on the other hand, it is necessary to determine and analyse perceptions and expectations, in order to manage eventual resistances and provide solutions liable to being adopted and udes efficiently. this work reports the results of a study designed to find answers to these questions. it also allowed finding out the competences potential teleworkers need to have, enabling the progress of training actions and the development of insertion strategies adapted to the teleworkers and to the needs and expectations of employing companies.

Abstract: the new technologies of control in contemporary organizations rely on the constitution of the adequate subjects for performing organizational roles. their objective is to control at a distance, instead of the direct supervising of individuals. it can be said that teleworking is the managerial initiative that has taken further the idea of distance between organizations and individuals. this paper aims at exploring how organizational control takes place in a situation in which physical distance between organization and individual is clearly established. twenty-five teleworkers residing in rio de janeiro city were interviewed. all of the interviewees are teleworkers who hold stead job positions and perform knowledge-intensive tasks.

Abstract: this article results from a research on telework which was conducted with six public and private organizations. we also did a phone survey for which we have some 500 respondents, half of which are “salaried teleworkers”. after having presented a portrait of who does telework, we deal with issues such as the impacts of telework on work organization and working conditions, as well as the advantages and disadvantages that workers see in telework. we also address the issue of satisfaction among teleworkers, and conclude on the main dimensions to be addressed by organizations that want to implement telework. while the research was not carried out in brazil, but in canada, brazilian firms have the same interest as canadian firms in developing telework, that is reducing urban congestion, increasing their presence in different parts of the large national territory and ensuring the satisfaction of their workers to increase productivity and quality.
Consumption of Advanced Internet Services in the Enterprises Sector: the Spread of Telework in the Metropolitan Area of Madrid

Abstract: One of the pillars of the technological revolution that began in the seventies was the development of the Internet. This network has evolved in such a way that it now forms a complex structure that radically changed the social and economic dynamics at the end of century XX. Nowadays, new technologies allow anything from communication and information exchange to the realization of complex financial transactions, all from anywhere in the world and almost instantaneously. In spite of the widespread use of the Internet, there are still territories and inhabitants, mostly emplaced in remote rural areas, who live outside of this technological revolution. By contrast, urban areas enjoy a privileged position in the dissemination of the information society by concentrating most of the telecommunications infrastructure and monopolize the most qualified people. But there are many disparities in terms of diffusion of new technologies and these will transfer, in turn, to the enterprise sector which is the subject of this research. The differences in the use of new technologies and more specifically the use of advanced services on the Internet are related to the sector where the population is employed and its level of training. One of the advanced services offered by the Network is teleworking. Nowadays there are companies that offer their employees the opportunity to develop their professional activities outside their headquarters, using their homes as an alternative or call centers enabled with computers and Internet access. The purpose of this research is the study of the consumption of Internet advanced services by companies in the metropolitan area of Madrid, analyzing the spread of telework in more detail,a potential offered by new technologies and which may modify the current pattern of mobility in the main urban areas because it is from here where big companies are guiding the global economy.
Telework organization model as method of development of disabled persons’ employment quality

Abstract: Problem of employment for disabled persons is partly connected with permanent changes and technical achievements in labour market. Telework in particular circumstances creates for disabled persons positive opportunity of choice. Accomplished research of authors analyzes the employment quality factors and proves that implementation of telework model for disabled persons could improve quality of employment of such persons in comparison with recent system of profession rehabilitation and disabled persons employment.

Abstract: The way of employment is changing. The primary and secondary sector offers less and less workplaces, shifting employment into the tertiary sector. Nevertheless, we are facing increasing rural unemployment, as the tertiary sector is based mostly around the high populated towns, but the primary and secondary sector generates unemployment in the rural areas. This trend projects a vision of a very centralized Europe, which is opposite with the efforts of regionalization. In this study we evaluate these trends, and build a generic model which can be used to create employment opportunities in the rural areas, based on the specificities of the tertiary sector.
