Maslahah and its Potential Role in Formation of an Islamic Perspective on Sociology

Abstract: This study analysis Islamic and Western world views briefly in a comparative perspective and attempts to analysis their influence and effect in the explanation of social phenomenon. It also delineates the two major problems of modern sociology, mainly, lack of universality and lack of applicability due to elemental mistake in the data of human behaviour and its Western value orientation. Using both comparative and analytical methods, the researcher makes his case for the necessity of drawing an Islamic perspective on sociology. Through the application of juristic principle of maslahah from three aspects, from the aspect of provision of material source, introduction of universal values and the endowing of purpose to corpus of sociological knowledge.

Abstract: The Federal Constitution has granted jurisdiction over Islamic affairs to each state through the 2nd list of the 9th schedule. Based on this jurisdiction, the states have approved laws relating to the Muslim community including distribution of a deceased estate. In the context of a multi-ethnic Muslim community, state customary and traditional laws pose a rather significant challenge to the effective operation of Shariah Courts. Results of a study conducted in 2009 indicate that elements of ethnicity and custom have more or less constrained the Shariah Courts from carrying outthis jurisdiction. It is observed that in addition to consulting the Shariah Courts, bumiputra communities in the study area continue to adhere to customs in matters relating tothe distribution of inheritance. This study discusses this phenomena and attempts to deliberate on the approach adopted by courts in handling of the relevant cases.

Abstract: The purpose of this study is to trace and analyze the development of maslahah as a dynamic principle of the Islamic jurisprudence of a high methodological significance. To achieve this objective, the researchers undertake an in depth study of jurists discourse on the subject, tracing various stages of its development. Both historical and analytical methods are adopted in this study. The researchers by referring to Muslim jurists discourse on maslahah in the context of the development of legal theory, derive the conclusion that maslahah initially was perceived as a notion of consideration of public welfare. However, its use in this sense was on ad hoc basis and lacked consistency. Its elaborate discussion and hence, recognition as a mature technical term materialised during the 5th century of hijrah. This can be observed clearly from the writings of Muslims jurists of pre-al-Ghazali during al-Ghazali and post-al-Ghazali periods including those of al-Ghazali s writings, himself. However, Al-Shatibi discussion of maslahah within the framework of the theory of the purposes of the law made it of remarkable and profound importance to methodological reconstruction and renewal of Islamic law.

Abstract: The development of modern biotechnological plants through genetic engineering techniques is a method to improve the quality of crops in terms of quality and quantity. However, the debate among scientists and Muslim scholars in regarding with public interest and public corruption as to plant products that produced by modern biotechnology which is well-known now a days as Genetically Modified (GM) food is never stop. Thus, in the Islamic law there are a few methods of preponderance or predominance which could be used in order to find out the best way out of confusion in certain cases for legal rulings, especially in the cases relating to GM food. The objectives of this study are to examine the considerations of maslahah and mafsadah in purposes of Islamic law in relating to issues of modern biotechnology and to elucidate the methods of preponderance as well. It is important to understand here is everything that existed on this earth whether it occurs naturally or is present through the efforts of research and human expertise, all have benefits or advantages and risks or disadvantages. In the view of Islamic law if a biotechnological product is produced by hybrid efforts of using unlawful genes it is certainly clear can be categorized as illegal to be consumed then it becomes forbidden. But however, there are many products that are produced through biotechnological processes are unclearly able to decide easily whether they are lawful or unlawful for consumption by consumers. As such, a few methods laid down in this study are the first attempt to give a way out of difficulties for easily making legal rulings in this issue. So, it is hoped that the substance of this study will give an initial guidance for Muslim scholars to make legal judgment if they are facing the issues of GM food.

Abstract: Poverty is not something new issue for a country. Poverty is seen as a problem that could negatively impact on a country. Malaysia also cannot escape from this poverty problem. Malaysia is a country where the Moslem people are majority and they are permanent resident. Therefore, from the perspective of Islam, poverty had been seen as a social disease [1]. According to the post’ or scholars’ statement, one of the ways poverty can be overcome is the implementation of the community development program. One of the community development programs in Malaysia that for farmer and house hold that involve in agriculture is called AZAM Tani. A study was conducted on participants AZAM Tani (Agricultural AZAM) areas of Seberang Perai, Penang. AZAM are words in Malay language. It is also short form and stand for End Time of The Poor. The method used was census. A total of 54 respondents were found. The results showed that the AZAM Tani program is able to help increase knowledge. Then with the knowledge that the participants had, they are able to raise their level of skills. This can be seen in the results of Spearman correlation indicating the relevance of knowledge to the implementation of the program and the relevance of relationship knowledge and skills with r = 0.612, p < 0.05. This relationship is positive. The study also shows an increase in the income level of the respondents.

Abstract: This article presents a novel approach for the measurement and estimation of network traffic utilization between network nodes in heterogeneous environment. This research investigates performance evaluation of network interface on heterogeneous services and technologies environment. This study proposes an enhanced equation to evaluate the performance of network interface via Little Law and Queuing theories to improve the evaluation algorithm. To get accuracy results on the performance of simulation model, it measures (verify and validate) data from Local Area Network (real network environment). This project uses network management tool to capture those data and Fluke Optiview device to generate traffic. As a result, this simulation model can provide a good approximation of the real traffic observed in the real network environment. Through laboratory and field experiments, the result shows that the model via simulation is capable of approximating the performance of network utilization and traffic over heterogeneous services and techniques within a minimum error range.
Improved NCTF Control Method for a Two-Mass Rotary Positioning Systems  [PDF]

Abstract: This paper describes an improvement of the existing nominal characteristic trajectory following (NCTF) as a practical control method for a two-mass rotary point-to-point (PTP) positioning systems. Generally, the NCTF controller consists of a nominal characteristic trajectory (NCT) and a PI compensator. A notch filter is added as a part of the compensator to eliminate the vibration due to the mechanical resonance of the plant. The objective of the NCTF controller is to make the object motion follow the NCT and end at its origin. The NCTF controller is designed based on a simple open-loop experiment of the object. The parameters identification and an exact model of the plant are not necessary for controller design. The performance response of improved NCTF controller is evaluated and discussed based on results of simulation. The effect of the design parameters on the robustness of the NCTF controller to inertia and friction variations is evaluated and compared with conventional PID controller. The results show that the improved NCTF controller has a better positioning performance and is much more robust than the PID controller.

However, comparatively little is known about the international entrepreneurship (IE), its capability and what drives the international performance of these firms with early and rapidly internationalizations. Therefore, the objective of the investigation is to reveal the dimensions of international entrepreneurial capability (IEC) and its effect on international performance (IP) in born global firms. The study will give an instruction to the born global (BG) managers, vision and strategy to the policymakers, and introduce the effectiveness role of international entrepreneurship capability (IEC) on international performance.
Poly(Acrylamide-Co-Acrylic Acid)-Zinc Acetate Polymer Electrolytes: Studies Based on Structural and Morphology and Electrical Spectroscopy  [PDF]

Solid polymer electrolytes (SPEs) of polyacrylamide-co-acrylic acid (PAA) as the polymer host and zinc acetate (ZnA) as an ionic dopant were prepared using a single solvent by the solution casting technique. The amorphous and crystalline structures of film were investigated by X-ray diffraction (XRD). The surface morphology of samples was examined by scanning electron microscopy (SEM). The composition and complex formation of films were characterized by Fourier transform infrared (FTIR) spectroscopy. The conductivity of the PAA-ZnA films was determined by electrochemical impedance spectroscopy. According to the XRD and FTIR analyses, all electrolyte films were in amorphous state and the existence of interaction between Zn2+ cations and the PAA structure confirms that the film was successfully prepared. The SEM observations reveal that the electrolyte films appeared to be rough and flat with irregularly shaped surfaces. The highest ionic conductivity (σ) of 1.82 × 10-5 Scm-1 was achieved at room temperature (303 K) for the sample containing 10 wt % ZnA.

Hydrodynamic Modelling of Bidong Island Vicinity Waters  [PDF]

Abstract: This paper explores the dynamic of meteorological forcing on current circulation pattern in the vicinity of Bidong using an unstructured flexible mesh hydrodynamic model. The forcings were wind, tides, temperature and salinity. The seasonal wind monsoon, mixed tides with dominant diurnal and tropical monsoon climate is characteristics of Bidong Island. We find that this area has different current circulation patterns in response to monsoon changes. It also experienced a small scale of island wake during NE monsoon. This island wake was generated by a strong northeasterly wind. We performed a series of numerical simulations based on three dominant factors in circulation, and evaluated the model using wind, tides and density. We investigated the wind-driven circulation and residual current. This study contributes to the debates on hydrodynamic of current circulation in vicinity of Bidong Island. Specifically, this study was conducted to understand the changes of currents by seasonal wind (NE monsoon and SW monsoon), temperature and salinity.
