The Challenge Faced by Shariah Law in Respect of Distribution of Inheritance in Multi-Ethnic Communities: Case Study in Beaufort, Sabah, Malaysia

Abstract: The Federal Constitution has granted jurisdiction over Islamic affairs to each state through the 2nd list of the 9th schedule. Based on this jurisdiction, the states have approved laws relating to the Muslim community including distribution of a deceased estate. In the context of a multi-ethnic Muslim community, state customary and traditional laws pose a rather significant challenge to the effective operation of Shariah Courts. Results of a study conducted in 2009 indicate that elements of ethnicity and custom have more or less constrained the Shariah Courts from carrying outthis jurisdiction. It is observed that in addition to consulting the Shariah Courts, bumiputra communities in the study area continue to adhere to customs in matters relating tothe distribution of inheritance. This study discusses this phenomena and attempts to deliberate on the approach adopted by courts in handling of the relevant cases.

Abstract: Islamic banking system is a system that emphasizes justice and avoid injustice to buden the riba of the loan. Anumber of financing instruments have been introduced by Muslim scholars in order to achieve these objectives. Between existing instruments such as sale al Inah and Tawarruq. However, both of these instruments still have seen elements of usury by some experts in Islamic finance. This study aims to explain the conditional grant in accordance with the law and explain the relevance of past jurists to be one of the Islamic financing instruments. The study will examine the books containing the views of jurists from different schools to get a clear picture of this problem and then find the best and moderate views. Based on this view, this study explains how the grant agreement can become an instrument of financing in the Islamic financial system.

Abstract: The Islamic banks are considered modern institutions in the banking industry, it made noticeable steps in the banking area. Working human resources had the distinguished impact in that development. Under the human resources, all essential activities of the institution are included such as planning resources, recruitment, training and development, performance evaluation, compensation, safety and health and work relations. These involve the conventional bases for the human resources management which includes the management of change, culture, labour and organizational designing and human resources activities, internally and externally. The human resources represent the main element for research. It is considered to be the capital for any producing nation in reality. Also, human resources come at the top of elements list of the administrative process which cannot do without it.

Abstract: The Islamic banking marketing is regarded as one of the crucial factors for developing and success of these banks in the far-scope time. The Islamic banks succeeded to offer modern banking services which have been professionally marketed. Although, the conventional banks have preceded it in that filed, it succeeded in expressing the Islamic banking. The concept of marketing is considered to be modern to the Islamic banking industry for it relied on the Muslims Islamic sentiments in dealing with it. As to the present time, the competition enforced it to take much concern in that field.

Abstract: The purpose of this study is to trace and analyze the development of maslahah as a dynamic principle of the Islamic jurisprudence of a high methodological significance. To achieve this objective, the researchers undertake an in depth study of jurists discourse on the subject, tracing various stages of its development. Both historical and analytical methods are adopted in this study. The researchers by referring to Muslim jurists discourse on maslahah in the context of the development of legal theory, derive the conclusion that maslahah initially was perceived as a notion of consideration of public welfare. However, its use in this sense was on ad hoc basis and lacked consistency. Its elaborate discussion and hence, recognition as a mature technical term materialised during the 5th century of hijrah. This can be observed clearly from the writings of Muslims jurists of pre-al-Ghazali during al-Ghazali and post-al-Ghazali periods including those of al-Ghazali s writings, himself. However, Al-Shatibi discussion of maslahah within the framework of the theory of the purposes of the law made it of remarkable and profound importance to methodological reconstruction and renewal of Islamic law.

Abstract: The development of modern biotechnological plants through genetic engineering techniques is a method to improve the quality of crops in terms of quality and quantity. However, the debate among scientists and Muslim scholars in regarding with public interest and public corruption as to plant products that produced by modern biotechnology which is well-known now a days as Genetically Modified (GM) food is never stop. Thus, in the Islamic law there are a few methods of preponderance or predominance which could be used in order to find out the best way out of confusion in certain cases for legal rulings, especially in the cases relating to GM food. The objectives of this study are to examine the considerations of maslahah and mafsadah in purposes of Islamic law in relating to issues of modern biotechnology and to elucidate the methods of preponderance as well. It is important to understand here is everything that existed on this earth whether it occurs naturally or is present through the efforts of research and human expertise, all have benefits or advantages and risks or disadvantages. In the view of Islamic law if a biotechnological product is produced by hybrid efforts of using unlawful genes it is certainly clear can be categorized as illegal to be consumed then it becomes forbidden. But however, there are many products that are produced through biotechnological processes are unclearly able to decide easily whether they are lawful or unlawful for consumption by consumers. As such, a few methods laid down in this study are the first attempt to give a way out of difficulties for easily making legal rulings in this issue. So, it is hoped that the substance of this study will give an initial guidance for Muslim scholars to make legal judgment if they are facing the issues of GM food.

Abstract: This article discusses the present status of municipal solid waste management (MSWM) in Malaysia. The basic situation in large municipalities in Malaysia is one in which available resources are not sufficient to provide adequate municipal services to either the main stream of the population, or to those residing in the slum settlements. Effective waste management is dependent upon achieving informed consensus amongst interested parties. The problem for data collection and planning is the lack of locally available trained personnel and the need for relevant data. Most universities and educational institution fails to offer curriculum in waste management, and this neglect results in a serious lack of trained human resources necessary for the planning and implementation of waste management systems.
The Influence of Leadership Styles on Organizational Performance of Logistics Companies

Abstract: Empirical studies have highlighted that one of the organizational success factor is leadership. This suggests that leadership plays a key role for organizational performance. The purpose of this study was to examine the relationship between leadership styles and organizational performance. Further, the study determined the influence of leadership styles on organizational performance. Finally, the study examined the most important leadership style that influences organizational performance. Data in the study was collected from a sample of 150 managerial staff in Malaysian logistics companies. The obtained data were analyzed using SPSS Version 17. Descriptive and inferential statistics were employed to answer the objectives and hypotheses of the study. The study found that all of the leadership styles were related to organizational performance and contributed significantly to organizational performance. The study also revealed that transformational leadership style emerged as the most significant influence to organizational performance. The findings of the study provided empirical evidence that transformational leadership style has significantly enhanced the organizational performance in Malaysian logistic companies.

Abstract: Hubungan antara Tuhan dengan manusia dan hubungan antara manusia dengan manusia amat penting dalam kehidupan setiap hamba Allah s.w.t. Allah telah menetapkan takdir ke atas semua hamba-hamba-Nya dan takdir yang ditetapkan ini tidak boleh diubah-ubah. Takdir pula mempunyai pendirian yang tersendiri dalam menilai dan mengatur kehidupan harian. Konsep-konsep ini bertepatan dengan syariah dan ada pula yang bertentangan dengan hukum. Oleh itu, historiografi Islam memainkan peranan penting dalam membantu manusia memahami konsep takdir untuk menentukan bentuk kehidupan manusia dan turut memahami peranan manusia juga dalam bentuk kehidupannya sendiri. Jesteru, perkaitan hubungan antara manusia dan Allah s.w.t itu amat jelas dalam menentukan halatuju kehidupan yang harmoni yang sentiasa berlandaskan Al-Quran dan Al-Sunnah agar konsep usaha, doa dan tawakal sentiasa menjadi landasan dalam mengatur kehidupan seseorang insan yang bergelar mukmin.
