Theories of Punishment in the Age of Mass Incarceration: A Closer Look at the Empirical Problem Silenced by Justificationism (The Brazilian Case)  [PDF]

The paper examines three central problems involving punitive social control in recent decades: first, the steady increase in the number of incarcerated people (the phenomenon of great confinement), with special emphasis on the Brazilian case; second, the way criminology interprets contemporary confinement (New Penology); and finally, the lack of a (dogmatic) criminal law theory on the reality of mass incarceration. Incarceration data are presented here as premises in order to inquire about the relations between the (normative-philosophical) theories regarding the justification of punishment and the (empirical) phenomena of mass incarceration. The questions behind the current reflection are therefore about what role criminal theories play in the expansion or contraction of the power to punish (potestas puniendi) and the explanations the justification models offer to the problem of hyper-punishment.

The purpose of this research is to approach queer theories and the critical perspectives of criminology in Brazil by analyzing both the conditions of the possibility and the implications of a queer criminology. Homophobic violence is seen here as the object of study of a queer criminological perspective, whose ambition is the construction of a qualified perspective that is aware of diversity, concerned with human rights and, above all, non-discriminating towards the (positive and negative) political demands of social movements represented by gays, lesbians, bisexuals and transsexuals.

Abstract: O estudo avalia as práticas punitivas como mnemotécnicas, aproximando a perspectiva filosófica de Nietzsche e a teoria agnóstica da pena. A hipótese desenvolvida na investiga o é de que a ritualiza o e institucionaliza o dos castigos, através dos primitivos procedimentos penais, atuam como mecanismos de manuten o da memória dos delitos, da "culpa moral" e do "sentimento de dever". The study analyses the punishing practices as mnemotechniques, bringing closer Nietzche’s philosophical perspective and the agnostic theory of punishment. The hypothesis developed in the research is that both the ritualized practice and the institucionalization of punishment, through primitive criminal procedures, act as mechanisms of maintenance of the memory of the crime, “moral guilt” and “feeling of duty”.

Abstract: this article aims at demonstrating the possibility of criticism about the criminal law (lei 9.099/95) from two perspectives seen as marginal within penal law studies: the legal feminism and the penal criticism (garantismo). taking into account the victim's condition and the defendant's rights during the criminal proceedings, such discourses are linked to show the inefficacy of that law towards both the victim and the defendant.

Abstract: The article presents the normative framework of alternatives to sanctions and the mechanisms of procedural diversification in the Brazilian Law, more specifically in laws 8.069/90, 9.099/95 and 9.714/78. In a comparative approach, it evaluates both the penal law system and the juvenile law system of response to offenses, highlighting the penalties applicable to young offenders in conflict with the law. The study analyzes the process of community service, problematizing the existing tension between alternative sanctions to incarceration and the expansion of the punitive power in the contemporary world (punitivism).Resumo: O artigo apresenta o quadro normativo de alternativas às penas e às medidas (socioeducativas e de seguran a) e os mecanismos de diversifica o processual no direito brasileiro no Estatuto da Crian a e do Adolescente (Lei n. 8.069/90), na Lei dos Juizados Especiais Criminais (Lei n. 9.099/95) e na Lei das Penas Alternativas (Lei n. 9.714/78). A partir de uma abordagem comparativa, avalia os sistemas de direito penal e de direito juvenil de resposta ao ilícito, enfatizando as san es aplicáveis ao adolescente em conflito com a lei. Concretiza o estudo na análise da presta o de servi o à comunidade, problematizando a tens o entre as san es alternativas ao encarceramento e a amplia o da rede do poder punitivo na contemporaneidade (punitivismo).

Abstract: It is already widely known fact that e-business has been adopted across industries to better manage internal business processes as well as interfacing activities. Different types ofe-business systems including E-CRM, E-SCM, ERP1/2 among others are used to manageabove mentioned processes. Both in the academic and the business worlds e-business hasreceived undivided attention for over decade now. The focus has been on consumer marketsas well as business markets, the latter forms larger proportion of e-business when measuredin economic terms. This is our focus area. Contrary to conventional knowledge, it has beenillustrated that electronic marketplaces weaken existing business relationships and thuspertinent focus of this paper is not on these marketplaces but on business relationships.Therefore, main purpose of this paper is to conceptualize and empirically display howe-business impacts on the structure and interaction in a business relationships. In anutshell, this means we are describing novel ways to conceptualize relationship structureand process characteristics. To address this, we have made a broad literature review thatcovers pertinent parts of e-business literature and applicable aspects of businessrelationship discussion. A twin case study was conducted to compare the developedtheoretical framework with real world presented by the steel industry case studies in orderto form solid ground for our empirically grounded framework. The preliminary findingssuggest that antecedent for successful e-business adoption is a proper digital infrastructureand from there e-business enables and facilitates routine processes in relationships.

Abstract: Knowledge management has been recognized as an effective tool for improving the performance and productivity of organizations in this knowledge era. In this sense, knowledge management is a process. Knowledge management is a process of acquisition, validation,utilization, sharing, storage and diffusion of knowledge. However, many organizations have not implemented knowledge management in their strategic vision, mission and goals. Some organizations have articulated knowledge management, however, in an unsustainable way. One of the reasons is the limitation of leadership in accessing knowledge and the sources of knowledge. For that reason, this study attempts to address the implications of knowledge management sustainability for leadership in organizations through reviewing the contemporary literature and analyzing knowledge management practices in Bangwita. This study concludes that knowledge management sustainability in the organization has the implications for leadership. These implications are that knowledge management is a driving force for leaders in designing vision and mission in the organization, creating a conducive environment for knowledgemanagement initiatives, empowering, creating knowledge management systems and openness to change. This study is contextual. The objective is to offer insights into the knowledge sharingprocess and the results to a wider community who can consider the transferability of knowledge in their own context.

Abstract: We prove a conjecture of P. Guillon and G. Richard by showing that cellular automata that eventually fix all cells to a fixed symbol 0 are nilpotent on S^Z^d for all d. We also briefly discuss nilpotency on other subshifts, and show that weak nilpotency implies nilpotency in all subshifts and all dimensions, since we do not know a published reference for this.
