Missing persons and social exclusion

Abstract: The concept of social exclusion is used to explore the relationship between people and groups who may be socially and economically disadvantaged and the phenomenon of going missing. Police data about missing persons are compared to census data to determine whether groups who experience family dissolution, labour market exclusion, and other forms of disadvantage and social exclusion are overrepresented among people reported missing compared to the general population. The analysis shows that disadvantaged youth, women, Aboriginal people, people who are not in the labour force, unemployed people, and homeless people are all overrepresented among people reported missing.People occupying the intersections of multiple high risk categories are at particularly high risk of being reported missing. Linking missing persons with the concept of social exclusion shows that social and economic disadvantage can lead directly and indirectly to peoples’ disappearances.
Clinical EFT as an Evidence-Based Practice for the Treatment of Psychological and Physiological Conditions  [PDF]

Abstract:

Emotional Freedom Techniques (EFT) has moved in the past two decades from a fringe therapy to widespread professional acceptance. This paper defines Clinical EFT, the method validated in many research studies, and shows it to be an “evidence-based” practice. It describes standards by which therapies may be evaluated, such as those of the American Psychological Association (APA) Division 12 Task Force, and reviews the studies showing that Clinical EFT meets these criteria. Several research domains are discussed, summarizing studies of: 1) psychological conditions such as anxiety, depression, phobias, and posttraumatic stress disorder (PTSD); 2) physiological problems such as pain and autoimmune conditions; 3) professional and sports performance; and 4) the physiological mechanisms of action of Clinical EFT. The paper lists the conclusions that may be drawn from this body of evidence, which includes 23 randomized controlled trials and 17 within-subjects studies. The three essential ingredients of Clinical EFT are described: exposure, cognitive shift, and acupressure. The latter is shown to be an essential ingredient in EFT’s efficacy, and not merely a placebo. New evidence from emerging fields such as epigenetics, neural plasticity, psychoneuroimmunology, and evolutionary biology confirms the central link between emotion and physiology, and points to somatic stimulation as the element common to emerging psychotherapeutic methods. The paper outlines the next steps in EFT research, such as smartphone-based data gathering, large-scale group therapy, and the use of biomarkers. It concludes that Clinical EFT is a stable and mature method with an extensive evidence base. These characteristics have led to growing acceptance in primary care settings as a safe, rapid, reliable, and effective treatment for both psychological and medical diagnoses.

El delito de maltrato habitual en la Ley No 20.066 a la luz del derecho comparado

Abstract: El artículo presenta un examen del delito de malos tratos habituales en la legislación chilena a la luz de la experiencia comparada. Al diagnóstico inicial sobre la regulación legal nacional y de legislación comparada, le sigue la identificación de algunos de los núcleos problemáticos en el tipo penal. En la legislación comparada se da preeminencia a la legislación espa ola, cuyos tipos penales, sus reformas e interpretaciones doctrinarias (especialmente las primeras)han sido las que inspiraron la actual redacción del art. 14 de la Ley N° 20.066. En los núcleos problemáticos se examinan el bien jurídico protegido y los principales elementos del tipo objetivo (conducta, sujetos, la habitualidad, etc.) así como un aspecto procedimental. Se finaliza con una propuesta de lege ferenda.
A Review of Weapon Choice in Violent and Sexual Crime  [PDF]

Abstract:

The concept that weapon choice and use may play a valuable role in differentiating between offenders is one that has not been well explored in current criminological or psychological thinking. The key aim of the current paper is to discuss the role of weapon choice and use in the application of offender profiling. Relevant research is identified though a literature review: initially considering a broad range of offences and then narrowing the focus on the specific case of violent and sexual offences. The review highlights several key findings which are then conceptualised through the offender profiling literature. In the discussion, the paper argues that there is considerable merit in the consideration of weapons within profiling violent and sexual offenders and concludes with proposed dimensions (planning and emotional use of the weapon) that illustrate the range of motivations that may aid in discriminating offenders.

Abstract: We conducted a review of the peer-reviewed literature focused on conducting community health needs assessments and highlighted the necessary steps to conduct a community health needs assessment in a rural community. From the literature review, we identified three steps necessary— establishing partnerships, using a mixed methods approach, and disseminating results—to successfully conduct a needs assessment that fitted the definition of the Affordable Care Act. These three steps have been used as a guide for developing a protocol for conducting a community health needs assessment in Meadville, PA. We detail our preliminary project protocol here.
Aflatoxin M1 in milk by immunoaffinity column cleanup with TLC/HPLC determination

Abstract: during 2002 and 2003, a total of 107 samples of raw, pasteurized and ultrahigh treated temperature (uht) milk commercialized in the cities of s?o paulo and marília (sp) were analyzed for the presence of aflatoxin m1 (afm1). afm1 was detected in 79 (73.8%) of milk samples, ranging from <0.02 to 0.26 mg/l.the samples were analyzed using an immunoaffinity column for cleanup and a thin layer chromatography for determining afm1. the parameters, such as recovery, repeatibility, detection and quantification limit were evaluated to optimize this method (in-house). based on spiked samples, the recovery values ranged from 85.83 to 73.86% at levels of 0.010-0.50 mg/l, respectively, and the relative standard deviation for repeatibility ranged from 7.73 to 2.08%. the quantification limit was 0.02 mg/l. the results of some samples analyzed by this method demonstrated a satisfatory correlation when compared with high performance liquid chromatography (hplc). in conclusion, immunoaffinity column cleanup gave excellent results for recovery, sensibility and sample through put. despite the high rate of occurrence of afm1 in samples in both cities, the contamination level could not be considered a serious public health hazard, according to brazilian legislation.

Abstract: the article presents an examination of the crime of habitual abuse in chilean legislation in the light of comparative experience. to the initial diagnosis of the legal regulation of national and comparative law, followed by the identification of some problematic cores in the offense. comparative law preeminence is given to spanish law, whose criminal types, its reforms and interpretations of doctrine (especially the first) were those that inspired the current wording of article 14 of law 20.066. in the problematic cores are considered the legally protected good and the main elements of the objective part of the offense (conduct, subjects, regularity, etc.) and a procedural aspect. it concludes with a proposal of lege ferenda.

Abstract: the neutrality of gender in legal language and in the interpretation of criminal law hinder the appreciation of certain circumstances under which a woman subdued to violence in a domestic environment can give death to a spouse or partner, and that can conduct to an eventual exemption of criminal responsibility; an exemption that courts are unlikely to grant. the possible paths to recognize them vary between the general defenses (legítimate self-defense, state of necessity) and non enforceability causes (insurmountable fear, irresistible force), being the latter the most preferential in courts, which then impedes considering that the homicide of the aggressor may be a conduct permitted by law, preferring to subsume the female conduct to abnormal mental states.

Abstract: El Anteproyecto de Código Penal (APCP) reproduce en su articulado la actual ley 18.314 (LCT), sobre conductas terroristas, sin considerar las falencias que ella presenta:no sólo se mantienen el agravado régimen punitivo y procesal, sino también un concepto de terrorismo difuso y ambiguo que conduce a la creación de tipos penalesabiertos, que al no considerar la finalidad política, como elemento subjetivo en el tipo,lo convierte en el cajón de sastre de otras conductas delictivas que poco o nada tienen que ver con el terrorismo; por otra parte, se encuentra ausente la exigencia del elemento estructural (organización terrorista) como elemento integrante del tipo objetivo, lo que conduce a la punición de conductas que más bien pertenecen al plano de la violencia social o espontánea. De este modo, se transforma una legislación en principio excepcional en parte del ordenamiento común, lo que resulta altamente discutible.

Abstract: La neutralidad de género en el lenguaje jurídico y en la interpretación del derecho penal dificulta la apreciación de circunstancias bajo las cuales una mujer sometida a malos tratos en el ámbito familiar puede dar muerte a su pareja, y que puedan conducir a una eventual exención de responsabilidad penal, exención que los tribunales son reacios a otorgar. Las vías posibles oscilan entre las causas de justificación (legítima defensa, estado de necesidad defensivo) y las causas de inexigibilidad (miedo insuperable, fuerza irresistible) siendo preferidas por los tribunales estas últimas, lo que impide entonces considerar que el homicidio del agresor pueda ser una conducta permitida por el derecho, prefiriéndose subsumir la conducta de la mujer dentro de estados mentales anormales.
