Judicial review and transitional justice: reflective judgment in three contexts

Abstract: Este artículo busca examinar las vías a través de las cuales las cortes de revisión constitucional han intentado discernir con sentimientos públicos dentro de sociedades emergentes de una situación de opresión y conflicto de alta escala. Un análisis comparativo de decisiones de revisión judicial de la Hungría post–comunista, de la Sudáfrica post–Apartheid y de la Argentina post–dictadura como casos que muestran como los jueces han, con mayor o menor éxito, reconocido y engranado pedagógicamente sentimientos sociales negativos de resentimiento e indignación hacia antiguos víctimarios y beneficiarios de violencia. Así, el artículo espera cimentar el camino para investigaciones de mayor envergadura sobre uno de las dimensiones más descuidadas de sociedades post–confictuales: la influencia pública. / This article seeks to examine the ways in which courts of constitutional review have tried to deal with public sentiments within societies emerging from large–scale oppression and conflict. A comparative analysis of judicial review decisions from post–communist Hungary, post–Apartheid South Africa and post–dictatorial Argentina is meant to show–case how judges have,more or less successfully, recognised and pedagogically engaged social negative feelings of resentment and indignation towards former victimisers and beneficiaries of violence. Thus, the article hopes to pave the way for more in–depth research on one of the most neglecteddimensions of post–conflict societies: public affect.

Abstract: O artigo visa analisar o modo como dois tribunais nacionais proferiram senten as penais em circunstancias de mobiliza o emocional e tens o política. As decis es a que se chegou na Argentina depois de 1983 e na Roménia, após o fim da ditadura de Ceau escu, ilustram a forma como os afectos dos cidad os influenciam as delibera es dos tribunais no ambito de processos penais. Ambos os casos demonstram como o poder judicial teve de entrar em diálogo com pedidos de repara o ressentidos e indignados. No entanto, enquanto o tribunal argentino filtrou as emo es garantindo um respeito igual por ambas as partes, impulsionando, assim, a causa da justi a democrática, o caso romeno serve de advertência sobre a maneira como n o se deve usar o direito penal para corrigir erros cometidos. Estes dois casos oferecem nos duas importantes li es acerca tanto dos obstáculos como das oportunidades associados às emo es públicas durante períodos de transforma o política radical. The paper seeks to analyse how two domestic courts decided criminal trials under circumstances of emotional mobilisation and political stress. Decisions from Argentina after 1983 and Romania after Ceau escu’s dictatorship illustrate how citizens’ affects influence courts’ choices within penal cases. Both cases show how the judiciary had to enter a dialogue with resentful and indignant claims for redress. However, while the Argentinean court filtered emotions through the strainer of equal respect and thus pushed the cause of democratic justice ahead, the Romanian case serves as a cautionary tale about how not to correct injustices through criminal law. These two cases provide us with important lessons about the obstacles, but also the opportunities, associated with public emotions during periods of radical political transformation. L’article a pour but d’analyser la fa on dont deux tribunaux nationaux rendent des jugements pénaux en des circonstances de mobilisation émotionnelle et de tension politique. Les décisions qui ont abouti en Argentine après 1983 et en Roumanie après la fin de la dictature de Ceau escu, illustrent bien la fa on dont les sentiments des citoyens influencent les délibérations des tribunaux dans le cadre de procès pénaux. Les deux cas démontrent comment il fallut que le pouvoir judicaire établisse un dialogue face aux demandes de réparation ressentis et indignés. Néanmoins, alors que le tribunal argentin filtra les émotions en garantissant un respect égal à chaque partie, donnant de la sorte une impulsion à la cause de la justice démocratique, le cas roumain sert d’avis quant à
Gender Differences in Motor Coordination at Young Students at Psychology

Abstract: The research highlights gender differences in motor coordination on visual task. The method: Participants were 68 students at Faculty of Psychology and Educational Sciences, University of Bucharest, Romania, 36 female and 32 male, aged between 18 and 23 years old (m=21.38; S.D.=1.72). The instruments: Two hand coordination test from Vienna Tests System. Results highlight that young female students have the ability to calibrate, correct the errors and to learn from errors statistically significant than young male students and the young male students are statistically significant more precisely in competing the task.
The Effects of Motor Coordination Error Duration on Reaction Time and Motivational Achievement Tasks among Young Romanian Psychology Students

Abstract: Present study is focused on highlighting the effects of motor coordination error duration on reaction time to multiple stimuli, on motivation from competition and on motivation from personal goals among young psychology students. Method: the participants were 65 undergraduate students, aged between 19 and 24 years old (m= 21.65; S.D. = 1.49), 32 male and 33 female, all from the Faculty of Psychology and Educational Sciences, University of Bucharest, Romania. Instruments were the Determination test, the Objective Achievement Motivation Test, and the two hand coordination test. Results: The first and sixth hypotheses were confirmed. According to these findings, there are statistically significant overall mean error duration differences in motivation from competition in young psychology students (t=2.13; p=0.037<0.05) and there are statistically significant overall mean error duration differences in correct reactions to multiple stimuli in young psychology students (t=2.0001; p=0.049<0.05). Future research on motivation from competition and on motivation from personal goals should relate anxiety level motivation achievement and performance impairment in competition.

Abstract: The growing importance of international competition is well recognized both in the business and academic environment. This article’s aim is to discusses the issue of how universities must learn to compete, given that national institutional context and everchanging environment facing many and different challenges. This means that, in some ways, the university has a central place and becomes more integrated into state’s economic activities and companies, than they were before. In the knowledge society, the university' mission is to create, develop and transfer knowledge capital in order to obtain valuable asset status in the modern economy. Therefore, universities face continous challenges due to globalization and internationalization of education, learning and research, and must satisfy higher quality demands, ‘measurable’ outcomes, and explicit economic benefits. Facing competition from other knowledge-providers, universities must change their identity from that of state-financed monopolies to self-financed participants in the knowledge - providing markets.

Abstract: Social dialogue is a component of economic and social life, which consists of discussions and agreements between social partners - trade unions and employers, and governmental factors, which aims to harmonize the interests of employers with those of employees, to ensure a climate of peace and Stability Guarantee social. This article describes the main features of social dialogue and its procedures. An important part is ascribed to the legal framework at European and national level, highlighting the main advantages of the new law on social dialogue, introduced in 2011.

Aspects of the relationship between the processing of stimuli in the peripheral perceptual field and in the perceptual central field

Abstract: As humans have limited information processing abilities and rely on three fallible mental functions: perception, attention and memory, the driving error is easy to appear. The purpose of this paper is to highlight the male/female differences in processing the perceptive information from the external stimuli in the peripheral visual field and to demonstrate that the mean of the estimate errors in evaluating the speed and distances in the central visual perceptual field is in inverse ratio to the reaction time value at the visual stimuli from the peripheral driving tasks simulation. Between the variables number of wrong reactions and number of omissions there has been obtained a relatively high negative correlation (r=-0.728, p<0.001). The result has a strong implication in visual stimuli processing during driving tasks.
