Abstract: the persistent use of the "theory of the public agency" to resolve matters of state liability makes it advisable to review that theory. a dogmatic reconstruction of that theory reveals its complexity and limitations in explaining the way in which the liability of the state may be compromised. without providing rules on liability, the theory proves incapable of justifying the regime of state liability under the law. preferring a functional focus, the study proposes to discard the theory in order to solve this type of problems.

Abstract: El recurso persistente a la teoría del órgano administrativo para resolver cuestiones de responsabilidad pública aconseja revisar esa teoría. Una reconstrucción dogmática de esa teoría permite apreciar su complejidad y sus limitaciones para explicar la forma en que la responsabilidad del Estado puede verse comprometida. Sin suministrar reglas de responsabilidad, la teoría se muestra incapaz de justificar los regímenes ni la extensión que asume la responsabilidad pública, conforme a la ley. Prefiriendo un enfoque funcional, el estudio propone prescindir de esta teoría para enfrentar esta clase de problemas. Detection of (In)activity Periods in Human Body Motion Using Inertial Sensors: A Comparative Study

Abstract: Determination of (in)activity periods when monitoring human body motion is a mandatory preprocessing step in all human inertial navigation and position analysis applications. Distinction of (in)activity needs to be established in order to allow the system to recompute the calibration parameters of the inertial sensors as well as the Zero Velocity Updates (ZUPT) of inertial navigation. The periodical recomputation of these parameters allows the application to maintain a constant degree of precision. This work presents a comparative study among different well known inertial magnitude-based detectors and proposes a new approach by applying spectrum-based detectors and memory-based detectors. A robust statistical comparison is carried out by the use of an accelerometer and angular rate signal synthesizer that mimics the output of accelerometers and gyroscopes when subjects are performing basic activities of daily life. Theoretical results are verified by testing the algorithms over signals gathered using an Inertial Measurement Unit (IMU). Detection accuracy rates of up to 97% are achieved.
Size Effects on the Entropy Production in Oscillatory Flow between Parallel Plates

Abstract: The heat transfer problem of a zero-mean oscillatory flow of a Maxwell fluid between infinite parallel plates with boundary conditions of the third kind is considered. The local and global time-averaged entropy production are computed, and the consequences of convective cooling of the plates are also assessed. It is found that the global entropy production is a minimum for certain suitable combination of the physical parameters and a discrete set of values of the separation between the parallel plates. The transferred heat at the plates also shows minima in the same discrete set of values of the plates separation.

Abstract: The heat transfer problem of a zero-mean oscillatory flow of a Maxwell fluid between infinite parallel plates with boundary conditions of the third kind is considered. With these conditions, the amount of heat entering or leaving the system depends on the external temperature as well as on the convective heat transfer coefficient. The local and global time-averaged entropy production are computed, and the consequences of convective cooling of the plates are also assessed. It is found that the global entropy production is a minimum for certain suitable combination of the physical parameters. For a discrete set of values of the oscillatory Reynolds number, the extracted heat from one of the plates shows maxima.

Abstract: the analysis of density, spatial distribution and gonadic histology of a thais chocolata population in small bay punta arenas (21°38's-70°09'w), has allowed define certain indicators, which show that the reproductive aggregations would take place in the shallow zone (13-15 m depth) at the same time reported for other populations of this species in northern chile. the feature that evidence such an event are referred to the aggregated distribution of sexually mature adults in the 13 m and 15 m isobath, a distinct times of the year. such times are different from these established for the legal veda. thus, this legal reduction should be restudied in order to protect reproduction of this specie and hence to prevent a potential collapse of the stock in the regions i and ii (18°-26°s), taking into account that the previous fishery in regions iii and iv (26°-32°s) have already collapsed since 1988

Abstract: reproductive and population parameters of thais chocolata that would contribute to the validation of the current extraction standards were obtained by performing a study in the protected area of la rinconada marine reserve, antofagasta, chile, from december 2008 to january 2010. in terms of reproduction, the results revealed asynchronic gonad development in the population, with specimens in different stages of maturity throughout the year. mature individuals were distributed between 5 and 13 m depth, forming aggregations at 5 m depth during much of the year. periods of greater maturity were observed from july to august and november to january, with the most important aggregations at the end of both periods. a relationship was observed between the months with the greatest maturity and aggregations and the months with the highest daily temperature fluctuations. at the population level, the results allowed us to estimate 2.3*106 individuals, with 39% of this population over the minimum legal size (55 mm). the relatively slow growth estimated for this population was probably influenced by the high variability of the bottom temperature in this area. the critical size and size at first maturity of the population were higher than the minimal legal size, making it is necessary to review the current fishing regulation for this species. the effectiveness of the state marine reserves in the conservation of this marine resource was demonstrated.
Influence of Lactation, Liveweight and Lipid Reserves at Mating on Reproductive Performance of Grazing Goats

Abstract: Multiparous goats (n=183) of undefined genotype (native x traditional dairy breeds) kept on a desert rangeland were used to assess the effect of concurrent pregnancy and lactation, liveweight and lipid reserves at the sternum at mating on reproductive performance. The extended lactation during the dry season, concurrent with pregnancy, was associated with a lower (P<0.01) pregnancy rate (60 vs 92% for lactating and dry does, respectively), prenatal wastage (77 vs 4%) and kidding rate (14 vs 88%). Body weight at mating, middle of gestation and parturition, as well as sternum width and skin thickness at the sternum region was not different between dry and lactating does. In a second analysis considering only the dry does, the proportion of does pregnant, as well as kidding rates were not affected by body weight of does at mating, middle of gestation and at parturition. However, mean litter size tended to be higher (P= 0.09) for heavier does at mating (1.65 ? 0.48 vs 1.46 ? 0.51) and at the middle (1.65 ? 0.48 vs 1.45 ? 0.51) of gestation. Mean litter weight also tended to be higher (P= 0.06) for heavier does at the middle of gestation (5.40 ? 0.83 vs 4.89 ? 0.87). Body energy reserves, as reflected in sternum width and skin thickness in the sternum region, tended to be related to kidding rates, with does with higher fat reserves supporting higher kidding rates (94 vs 83%; P<0.01). Litter size and weight did not differ among does with different body fat reserves. These data indicate that, although lactation concurrent with gestation in the dry season was not associated with a major weight loss, it had a drastic cost on reproductive effort. Moreover, mean litter size and weight tended to be positively influenced by body weight at mating but not by levels of sternum energy reserves of does.

Abstract: Para obtener antecedentes reproductivos y poblacionales de Thais chocolata que contribuyan a validar su actual normativa pesquera, se realizó un estudio en el área protegida de la reserva marina La Rinconada, Antofagasta, Chile, entre diciembre 2008 y enero 2010. Los resultados obtenidos indicaron a nivel reproductivo, que el desarrollo gonadal de la población es asincrónico, encontrándose ejemplares en diferentes etapas de maduración durante el a o. Los individuos maduros se estratificaron entre 5 y 13 m de profundidad, y gran parte del a o formaron agregaciones a 5 m de profundidad. Se determinaron períodos de mayor madurez en julio-agosto, y en noviembre-enero, manifestándose las agregaciones más importantes al final de ellos. Una relación se observó entre meses de mayor madurez y registro de agregaciones, con aquellos de mayor variación intradiaria de temperatura. A nivel poblacional los resultados permitieron estimar una población de 2,3*10(6) ejemplares, donde el 39% se encontró sobre la talla mínima legal (TML = 55 mm). Los parámetros de crecimiento mostraron crecimiento relativamente lento, que podría estar influenciado por la alta variabilidad que presenta la temperatura de fondo en este sector. Mientras que su talla crítica, y la talla de primera madurez sexual poblacional, resultaron ser mayores a la TML. Se determinó la necesidad de revisar la normativa pesquera actual de esta especie, y se demostró la efectividad de las reservas marinas propiciadas por el Estado en la conservación de los recursos marinos.
