Legal Protection of Performer''''s Rights

Abstract: A performer who has the double status of both a disseminator and an author is an important subject of the copyright relations. His performance is the object of the neighboring rights and does not have the characteristic of a work. The performing subject includes both the natural person and the legal person. A person who performs a non-literary work or a non-artistic work has the status of a performer and enjoys the performership. The contents of the legal relations between the performer and the copyright owner, between the audiovisual work and its producer, and those between broadcasting and television organizations will have to determined by the forms of the performance. The rights of the performer and that of the author coexist and will have to be coordinated once conflicts between them occur. In practice, the performer's rights are determined by the forms of the performer's performance.
Adaptive backstepping output feedback control for SISO nonlinear system using fuzzy neural networks

Abstract: In this paper, a new fuzzy-neural adaptive control approach is developed for a class of single-input and single-output (SISO) nonlinear systems with unmeasured states. Using fuzzy neural networks to approximate the unknown nonlinear functions, a fuzzy-neural adaptive observer is introduced for state estimation as well as system identification. Under the framework of the backstepping design, fuzzy-neural adaptive output feedback control is constructed rccursively. It is proven that the proposed fuzzy adaptive control approach guarantees the global boundedness property for all the signals, driving the tracking error to a small neighbordhood of the origin. Simulation example is included to illustrate the effectiveness of the proposed approach.

Abstract: 民间文学艺术作品法律保护立法滞后的现状威胁着人类文化的多元性及群体和民族的个性。历史和实证分析表明,民间文学艺术作品具有版权法意义上的作品性,版权保护应当是民间文学艺术作品法律保护中的核心手段。民间文学艺术作品的权利主体是多层次的。创作民间文学艺术作品的群体是原始的版权主体,传承人等相关主体则依其付出的劳动的性质获得相应的版权或其他权利。通过群体的代表或组织承担相应权益是民间文学艺术作品的集体版权实现的有效途径。应当针对民间文学艺术作品的特点构建相关的侵权行为和法律救济制度。
The Design and Stability Analysis of an Adaptive System Based on Linear T-S Fuzzy System

Abstract: An adaptive fuzzy controller of a class of affine nonlinear systems is presented. The approximators using linear T-S fuzzy logic system (FLS) are adopted to estimate the unknown functions and the tunable parameters are the coefficients of the consequent rules. Because of better estimating performance of linear T-S FLS, we can achieve a smaller tracking error than using Mamdani FLS. The closed-loop system can get global stability by using Lyapunov synthesis approach in the sense that all the signals involved are uniformly bounded. Simulation of inverted pendulum tracking is carried out to verify the design.

Abstract: Ball-milled bamboo (Neosinocalamus affinis) was first treated under ultrasound at 20 oC in 95% ethanol solution for 0 to 50 min, dissolved in sodium hydroxide/urea solution (7% NaOH/12% urea) at –12 oC, and then extracted with ethanol and dioxane to isolate lignin. The structure of the isolated lignin was characterized with a set of wet chemical and spectroscopic methods, including UV, FT-IR, 13C NMR, and HSQC spectroscopies. The results showed that the lignin extracted from bamboo consisted of p-hydroxyphenyl (H), guaiacyl (G), and syringyl (S) type lignins with minor cinnamate units. The predominate lignin inter-units were β-O-4′ ether linkages, followed by phenylcoumaran and a lower proportion of resinol and spirodienone. It was also found that the ester groups of lignin were cleaved during the pretreatment process with cold alkaline solution.

Abstract: 生境破坏是目前野生动物保护面临主要问题,加强生境恢复与重建对保护珍稀物种具有重要意义.将3S技术运用到北戴河地区鸻形目鸟类觅食生境评价中,分析了近20a(1987~2006年)北戴河地区鸻形目鸟类觅食生境的动态变化,结果:鸻形目鸟类最适宜觅食生境和适宜觅食生境分布面积在1993年最大;觅食生境变化以1993年为分水岭;最适宜觅食生境和适宜生分布面积呈下降趋势(倒U形分布),不适宜觅食生境分布面积呈增加趋势(U形分布).北戴河地区鸻形目鸟类觅食生境变化主要影响因素是人类活动增加.

Abstract: The object of copyright is a kind of quasipublic goods which is non-excludable and non-rival in consumption. For the purpose of making the best use of everything, qualified people and organizations are entitled to obtain statutory licenses to retransmit owners' works or distribute copies under the conditions specified by the law. The statutory licensing system in the American law is based on three principles: anti-monopolism, fair market price in negotiated terms, and maximizing the availability of creative works to the public. It affords the copyright owners fair protection to make owners' identification clear, obtain licensing fee distribution, and prohibit willful altering of the content of particular works or any commercial advertising or station announcement transmitted by the primary transmitter during, or immediately before or after, the transmission of such program. It endows copyright users with the right of secondary transmission and fair incomes under the existing economic conditions. Both sides have the obligation to cooperate with each other for their exertion of right and acquisition of evidence in substantial law and procedural law. Neglect violation is actionable as acts of infringement and fully subject to remedies provided by the law. Notwithstanding any provision of the antitrust laws, in negotiating statutory licenses in accordance with copyright law, any copyright owners and users may negotiate and agree upon the royalty rates and license terms and conditions for the performance. In the absence of negotiated license agreement, and upon the filing of a petition, a copyright arbitration royalty panel is to determine and establish such rates and terms, considering these for comparable types of performance and circumstances under the voluntary license negotiated under market conditions. Any decision of the agency should be under judicial reviews when it is appealed by aggrieved party who would be bound by it. In the absence of the systematization of statutory licensing proceedings in the American law, China has much to do to absorb all the forenamed theories and practices. Acquiescence licensing is characteristic of the Chinese system and shows its strongpoints, which may be reserved under particular conditions.
