La objeción de conciencia sanitaria en el ámbito penitenciario

Abstract: to be fully in accordance with constitutional doctrines the notion of conscientious objection must be understood as a manifestation of the fundamental right to ideological freedom as contained in art. 16.1 ce (assuming of course that all objecting conduct is legitimate), but it must also be understood as a principle. that is to say, any conflict between the subject's fundamental right and legal duty that he rejects must be resolved by the judge who must make a careful judgement of values and property. this fundamental right still exists and may invoked and exercised by inmates and health personnel in the prison context in the face of predictions of the forcible imposition of medical treatment as stated in the logp and rp, with no more limit than public order itself.

Abstract: Lo más coherente con la doctrina constitucional es concebir la objeción de conciencia como una manifestación del derecho fundamental a la libertad ideológica del art. 16.1 CE (asumiendo, por tanto, la legitimidad de toda conducta objetora), pero entendida como un principio; es decir: cualquier conflicto entre el derecho fundamental del sujeto y el deber jurídico que se rehúsa debe ser resuelto por el juez realizando un juicio ponderativo de bienes y valores. Este derecho fundamental persiste y puede ser invocado y ejercido por reclusos y personal sanitario en el contexto penitenciario, frente a las previsiones de imposición coactiva de tratamientos médico previstas por la LOGP y el RP, sin más límite que el orden público. What is the phylogenetic signal limit from mitogenomes? The reconciliation between mitochondrial and nuclear data in the Insecta class phylogeny

Abstract: Long-branch attraction (LBA) artefacts were detected in all the datasets. Methods using Bayesian inference outperformed maximum likelihood approaches, and LBA was avoided in Paraneoptera and Holometabola when using protein sequences and the site-heterogeneous mixture model CAT. The better performance of this method was evidenced by resulting topologies matching generally accepted hypotheses based on nuclear and/or morphological data, and was confirmed by cross-validation and simulation analyses. Using the CAT model, the order Strepsiptera was recovered as sister to Coleoptera for the first time using mitochondrial sequences, in agreement with recent results based on large nuclear and morphological datasets. Also the Hymenoptera-Mecopterida association was obtained, leaving Coleoptera and Strepsiptera as the basal groups of the holometabolan insects, which coincides with one of the two main competing hypotheses. For the Paraneroptera, the currently accepted non-monophyly of Homoptera was documented as a phylogenetic novelty for mitochondrial data. However, results were not satisfactory when exploring the entire Eumetabola, revealing the limits of the phylogenetic signal that can be extracted from Insecta mitogenomes. Based on the combined use of the five best topology-performing genes we obtained comparable results to whole mitogenomes, highlighting the important role of data quality.We show for the first time that mitogenomic data agrees with nuclear and morphological data for several of the most controversial insect evolutionary relationships, adding a new independent source of evidence to study relationships among insect orders. We propose that deeper divergences cannot be inferred with the current available methods due to sequence saturation and compositional bias inconsistencies. Abstract: environmental degradation, the loss of cultural diversity and especially what is considered cultural heritage and ecology, are actually the main issues of every day life, politics, planning and business. during the rio meeting (rio de janeiro, 1992) the concept of responsible tourism was born in an attempt to enhance respect and preservation with all actors involved. under the umbrella of responsibility, cultural tourism was one product that showed the biggest growth under the premises of the formula of all-embracing development of society. this article presents a revision of cultural tourism as a product, its importance for the new tourist order and its range and establishing in which way the tourist system had a tendency to get involved in cultural management and therefore as conditioned its profitability.

Abstract: the objective of this work is to find an explanation for the symbolic metamorphosis of modern societies, dating from the second half of the xx century in the planetary orbit. it deals with the emergence of a new religiosity that gives evidence to a new detached religious phase beyond the universe of christianity. religion does not speak as it use to but now transits its own space, constructs its own voice and communicates in another place. from this perspective, it is a religiosity that is in concordance with the more visible expressions of certain post modern codes, in the sense of its own construction: the realm of subjectivity, individualism, flexibility and pluralism.

Abstract: while human rights have emerged as cultural language, it has been intensified the struggle between cultures on what should be its content and interpretation. few authors and cultures do not accept the idea of human rights (its universality seems reduced to that), but each cultural area offer their concrete interpretation (and from there comes the breakdown of that universality). this work defends the possibility and the need to reconcile the universal dimension of rights (inherent to them) with the requirements arising from cultural diversity (inherent to the human being identity), overpassing a multicultural reading of rights (reductionist) and raising a basics points for transultural conception of such rights.

Abstract: Tourist growth is attributed, each time more habitually, to the cultural offer of the destinations. That idea is in some way true, but is it really the culture, the patrimony and cultural legacy of the towns, what activates the tourist flow towards a destination? The destinations and those that want to become destinations are dressing out and toiling in order to attract more and more visitors. Their success will depend on the success of their attractiveness. In this task, the resource use becomes intensive. Environment, leisure, sports, spaces, events of any nature and, of course, the local culture are useful for such an end. However, except those designed explicitly for the tourist, not all the resources are able to be presented, contemplated and understood in their complexity. They should be adapted for a repetitive, quick, interesting and simple use, ready for a glance, not for reading. This makes possible that for the same place, event or patrimonial device may exists different versions, several arguments according to the target groups and uses. From this point of view, would exist a cultural patrimony that could be activated, promoted and consumed or not, exclusively due to economic interests linked to tourism development
