Judges’ Continuing Construction in Enterprise-Conditioned Employer Dismissal in Germany: Specific Research of the Proportion Principle  [PDF]

Abstract: A common theme must be ensuring equity to protecting the job security of employees, when the enterprise owners implement the dismissal right due to enterprises reasons. There are yet many problems needing to be solved in the interpretation, application, construction and supplementation of the norm of “social rationality” according to German Federal Dismissal Protection Statute. It is important to Germany itself but will also have far-reaching effects on foreign countries that have enterprise in Germany. Nevertheless, it is not easy for designing a new control structure for such dismissal. In this paper, a legislative space of social rationality could be continuingly constructed or supplemented successfully. This should thus be welcomed by international judges, lawyers and citizens.

Abstract:

Multinational corporations pay great attention to the dismissal caused by enterprise owners (Arbeitgeberkündigung), especially in the fierce competition of market economy. In fact, the limits of dismissal rights of employers are also a key issue in human resources management. However, the importance of solving this problem reasonably is beyond the law itself. Once the rationality of the premises that are based on the legislation of dismissal limits is challenged, the solution drawn from deduction or induction becomes an issue of ambiguity. This paper will discuss the concept of “dismissal”, its differentiation with other related concepts, and the concept of dismissal limits from the perspective of German law. The study also discusses the following issue from the view upon legal theory: Are the dismissal’s “premises” of legislation and judicatory rational? This study also sheds lights on the comparative law in some developing countries.

Abstract: Taking the Donghaochong River as a study case, the environmental evolution process and spatial characteristics of Donghaochong River are analyzed through field investigation, questionnaire and in-depth interview in the context of urban renewal and combining relevant historical documents and statistical data. From the perspective of users, the behavior characteristics and use demand of surrounding users for waterfront space of Donghaochong River in Guangzhou City and the?evaluation of usage situation before and after reconstruction of Donghaochong River are summarized to provide relevant optimization suggestions for the creation of satisfactory waterfront landscape environment for users.

Abstract: The rapid development of Information Technology has revolutionized the way people and business transfer funds and has led European nations to enact new laws to regulate payments conducted electronically. The Macau law of negotiable instruments, mainly stipulated in Commercial Code of Macau and regulations concerning electronic fund transfers, have been influenced by modern European Law and principles in the way of absorbing the current legal expertise from western countries. In Macau, the Electronic Funds Transfer System provides a cost-effective and efficient method to transfer funds electronically directly into a specified bank or building society account. At the same time, it has significantly reduced the importance of the traditional negotiable instruments both in domestic and in international trade.

Abstract: With the rapid development of China’s economy, foreign investment in China’s industry has got strengthened in both breadth and depth. Transnational corporations, one of the sources of foreign investment, have done frequent M&A, hence having some actual and potential influences on China’s industry or even economy security. This article begins with the current situation and characteristics of transnational corporations’ M&A, then moves on to the positive and negative influences transnational corporations’ M&A in the recent time have on China’s industry security and puts forward some relevant strategies and suggestions for China about how to cope with M&A from the aspect of making reasonable use of foreign capital.

A stochastic-variational model for soft Mumford-Shah segmentation

Abstract: In contemporary image and vision analysis, stochastic approaches demonstrate great flexibility in representing and modeling complex phenomena, while variational-PDE methods gain enormous computational advantages over Monte-Carlo or other stochastic algorithms. In combination, the two can lead to much more powerful novel models and efficient algorithms. In the current work, we propose a stochastic-variational model for soft (or fuzzy) Mumford-Shah segmentation of mixture image patterns. Unlike the classical hard Mumford-Shah segmentation, the new model allows each pixel to belong to each image pattern with some probability. We show that soft segmentation leads to hard segmentation, and hence is more general. The modeling procedure, mathematical analysis, and computational implementation of the new model are explored in detail, and numerical examples of synthetic and natural images are presented.

Abstract: A vision sensing system for taking and processing the image of MIG welding pool of aluminum alloy has been setup in this paper. The morphological operator which can effectively wipe off noise and 'cathode pulverization' area in image was used to process the image of the aluminum alloy MIG welding pool. Based on the step response experiment, the welding pool width model of dynamic process in aluminum alloy pulsed MIG welding is identified by least square method. The input parameters of the model are welding wire speed, base current and pulse duty ratio, and the output is beam width of welding pool. The influence of wire speed, base current and pulse duty ratio on welding pool width is analyzed, which provides the theoretical basis to realize the intelligent control for aluminum alloy pulsed MIG welding process.
