Abstract: this article presents the central elements of the classic contractualist model of state legitimacy as displayed by thomas hobbes in leviathan. it aims to question the proposal made by leo strauss on hobbes? political philosophy according to which hobbes is the founder of liberalism. through an interpretation of the hobbesian theory of political representation, it intends to detach his image as a defender of political absolutism. the type of liberalism from which it is possible to show that hobbes? conception is unacceptable, is liberalism represented by authors such as benjamin constant, madame de st?el and alexis de tocqueville.

Abstract: abstract: this article discusses some of the proposals that modern and contemporary discussions offer on the normative methods for a new international order. it treats of the possibility of demanding, as a matter of justice, the transformation of the relations of power in the international economical and political orders, between the richest societies and the poorer ones. four different models of internal and interstate state order are exposed and criticized. first) the realist model of the absolutist state which establishes peace internally and externally through dissuasion, and which denies that a criteria of justice can be formulated to define the relations between states. second) the kantian model of state of law. third) the social state of rawls with two differentiated models of the contract to define the relations in the interior and the exterior and fourth) the cosmopolitan project. finally, the liberal project of justice is criticized because it reduces the problem of the re-ordering of the international order to distributive justice and does not question the structures of the actual global economic system.

Abstract: this paper discusses some of the proposals raised within the contemporary debate about normative models for a new international order. in the first part, the argumentative strategies of political realism, of john rawls' liberalism and of jürgen habermas' deliberative model are presented. these authors' objections to the cosmopolitan idea of a transformation in the international order based on the demands for global economic justice are debated. in the last part, the text shows that the proposal f global justice presented by thomas pogge is insufficient because, although it shows the implication of the global economic order in the increase of poverty and formulates a global redistributive proposal, it does not consider the problem of the transformation of the prevailing system of power relations within the current capitalist order.

Abstract: the author of this piece shows the key elements of the classic contractualist model of the state legitimacy, proposal by john locke in his major work two essays on civil government. this essay pretend to bring out that although hobbes as well as locke used the instruments of the social contract in order to justify the origin of the political power and both of them come from similar categories there is, nevertheless, a big difference between them. locke defends a model of the liberal state and hobbes personifies the justification of an absolutist state. this difference is emphasized basically because of the role that the doctrine of the resistance plays in locke’s theory. this one allows to show how is possible to conceive a political form whose power is not be irresistible.

Abstract: this article is based on the research of how constant and tocqueville correlate democracy and rule of law or with a form of political organization based on the division of powers and on legality; when the said correlation is not brought about in a reasonable way then democracy turns into its opposites: tyranny, dictatorship and despotism.

Abstract: This paper discusses some of the proposals raised within the contemporary debate about normative models for a new international order. Abstract: En este artículo se presentan los elementos centrales del modelo contractualista clásico de legitimación del Estado, expuesto por Thomas Hobbes en el Leviatán. Se cuestiona la interpretación propuesta por Leo Strauss sobre la filosofía política de Hobbes, según la cual, el filósofo inglés sería el fundador del liberalismo. Mediante una interpretación de la teoría de la representación política hobbesiana se intenta destacar su imagen como defensor del absolutismo político. El tipo de liberalismo a partir del cual es posible mostrar que la concepción de Hobbes resulta inaceptable es el liberalismo representado por autores como Benjamin Constant, Madame de St el y Alexis de Tocqueville. Abstract: En este artículo se investiga cómo Benjamin Constant y Alexis de Tocqueville correlacionaron la democracia con el Estado de derecho o con una forma de organización política basada en la división de poderes y en la legalidad; cuando esta correlación no se da de una forma razonable la democracia deriva en sus opuestos: la tiranía, la dictadura o el despotismo. Abstract: this article criticizes some of the theoretical proposals for global justice because they are not able to point out alternatives which will enable us to overcome the pressing problems of world poverty and the increase of the inequalities of the contemporary world. the central criticism points out that the proposals for global justice, such as rawls`, habermas` or pogge`s, are insufficient inasmuch as they reduce the problem of justice to a merely re-distributive matter. by restricting the problem of justice to a fair distribution of goods without bearing in mind the causes that determine social inequalitiestheories of global justice end up affirming the fundamental principles of the ruling domination system. to base these ideas, the authors take their bearings in the literature that michel aglietta, laurent berrebi, joseph stiglitz, paul krugman and the authors of the french regulationist school have been producing about the crisis of capitalism.
