EL SISTEMA DE CONTRATOS DE EXPLOTACIóN DEL BUQUE EN EL CóDIGO DE COMERCIO COLOMBIANO

Abstract: this article is the result of a study made at the sabana university under the project: "transformation on liability in colombian legislation after the approval of the trade agreements between colombia and the european union, and between colombia and the united states of america - maritime transportation chapter". this research demanded a rigorous review of the legislation on maritime transportation contracts in the commercial code. several resources such as history, judicial decisions, authors' opinions and comparative law were used. through this analysis we are able to understand that our legal system is based on the roman law structure 'locatio conductio", enriched by medieval and modern law. the distinction between transport, affreightment and rent contracts is based on the parties duties without ignoring the vessel as the instrument for maritime navigation. under this perspective, our system also follows the tradition established by other law systems like italian and argentinian law.

Abstract: the metropolitan region of bogota is the largest urban conglomerate in the country with a population close to eight million inhabitants in 2005, it comprises the capital district as the central city and the interconected sistem of sixteen cities and towns settled as a growing conurbation in the westwern sabana of the bogotá river; the demographic, economic and funtional dinamics, have made this conglomerate, the primacy region in the country. since mid twentieth century, when the city reached a population of seven hundred thousand inhabitants as most of the latin american capitals, it have grown in a highly accelerated manner, with a population projection close to ten millon for the year 2020. the central city has developed into a compact shape with a strong control on urban sprawl, and a well define urban structure. nevertheless, this is not a consolidated urban territory. different areas within the built city have not yet developed or on the contrary healthy urban areas developed in the past have reached strong precess of decadence or obsolescence. the urban development plan for bogotá enphacize a strong policy on developmen or redevelopment areas at the zonal scale, the intermediate street system, and the strengthening of secondary urban activity centers.

Abstract: El presente artículo trata de clarificar el panorama de las organizaciones comunistas que surgen en Espa a en los a os sesenta, setenta y ochenta y que darán lugar a un escenario en el que nos encontramos con decenas de organizaciones, grupos y movimientos que reclaman para sí la tradición revolucionaria del PCE, perdida en opinión de la mayoría a raíz del ascenso de Santiago Carrillo a la dirección del partido a finales de los cincuenta. Tratamos de organizar de manera clara el origen y las relaciones entre los diversos grupos escindidos así como las causas de su aparición y las características principales de su línea política.
Hacia la consolidación del territorio urbano del distrito capital de Bogotá

Abstract: La región metropolitana de Bogotá constituye la mayor aglomeración de población urbana en el país, cercana a 8.000.000 de habitantes en 2005, asentados en el Distrito Capital y 16 municipios interconectados en la Sabana del Río Bogotá. Su dinamismo demográfico, económico y funcional confirma su primacía urbana en el contexto nacional. Desde el inicio de la segunda mitad del siglo XX, cuando la ciudad llegó a tener 700.000 habitantes (como ocurría con otras capitales de América Latina), ha registrado un acelerado crecimiento que se ha mantenido hasta el presente, con una proyección de población cercana a 10.000.000 habitantes en el a o 2020. Si bien la ciudad central se ha desarrollado en forma compacta con significativo control en su expansión y con una estructura urbana definida, el desborde de su crecimiento poblacional se ha acelerado drásticamente y sin control sobre los 16 municipios periféricos de la aglomeración metropolitana. No obstante, Bogotá es una ciudad sin terminar: existe un importante potencial de redesarrollo en sus áreas vacías dentro de su perímetro o, por el contrario, existen considerables zonas en condiciones de decadencia, obsolescencia o abandono, y subutilización de sus estructuras. Abstract: Este artículo es fruto de la investigación realizada en la Universidad de la Sabana en desarrollo del proyecto "Transformaciones del ordenamiento jurídico colombiano en materia de responsabilidad a partir de la ratificación de los Tratados de Libre Comercio entre Colombia con la Unión Europea y con los Estados Unidos de América", capítulo "Transporte Marítimo", que nos exige como criterio preliminar una revisión rigurosa de la regulación de los contratos de explotación del buque en el Código de Comercio vigente. Metodológicamente se han utilizado los recursos histórico, doctrinal y de referencia al derecho comparado para el análisis de la legislación y la jurisprudencia aplicable. Este análisis nos ha posibilitado comprender que el sistema actual de regulación establecido en nuestro Código de Comercio sigue la estructura básica establecida en el derecho romano, articulada a través de la institución de la locatio conductio, que ha sido enriquecida y adicionada por el derecho medieval y moderno. La diferenciación de contratos de transporte marítimo de mercancías, fletamento y arrendamiento de buque regulados en el Código de Comercio se basa en el contenido obligacional de estas formas contractuales sin perder la perspectiva del buque como instrumento de la navegación marítima. En este punto nuestro sistema sigue la línea establecida por otros ordenamientos jurídicos como el italiano y el argentino en la regulación de la materia. Dirac Structures in Vakonomic Mechanics

Abstract: In this paper, we explore dynamics of the nonholonomic system called vakonomic mechanics in the context of Lagrange-Dirac dynamical systems using a Dirac structure and its associated Hamilton-Pontryagin variational principle. We first show the link between vakonomic mechanics and nonholonomic mechanics from the viewpoints of Dirac structures as well as Lagrangian submanifolds. Namely, we clarify that Lagrangian submanifold theory cannot represent nonholonomic mechanics properly, but vakonomic mechanics instead. Second, in order to represent vakonomic mechanics, we employ the space $TQ\times V^{\ast}$, where a vakonomic Lagrangian is defined from a given Lagrangian (possibly degenerate) subject to nonholonomic constraints. Then, we show how implicit vakonomic Euler-Lagrange equations can be formulated by the Hamilton-Pontryagin variational principle for the vakonomic Lagrangian on the extended Pontryagin bundle $(TQ\oplus T^{\ast}Q)\times V^{\ast}$. Associated with this variational principle, we establish a Dirac structure on $(TQ\oplus T^{\ast}Q)\times V^{\ast}$ to define an intrinsic vakonomic Lagrange-Dirac system. Furthermore, we establish another construction for the vakonomic Lagrange-Dirac system using a Dirac structure on $T^{\ast}Q\times V^{\ast}$, where we introduce a vakonomic Dirac differential. Lastly, we illustrate our theory of vakonomic Lagrange-Dirac systems by some examples such as the vakonomic skate and the vertical rolling coin.

Abstract: the 1978 spanish constitution established a distribution of competences between the central government (executive) and spanish regions (comunidades autónomas). some of the competences remained exclusive to the central government (executive) and others are shared with the regions. marine salvage is a shared competence. the central government has the right to create statutes, and the regions can execute them. each region must create its own statute of autonomy in agreement with the central government. at national level, maritime salvage is regulated by the spanish state ports and merchant marine act of 1992. this statute created a salvage national service agency (sociedad de salvamento y seguridad marítima - sasemar) which has been ratified by the spanish constitutional court as a valid rule. the canary islands autonomous community enacted several regional laws using its constitutional competences on maritime salvage.
