Abstract: The irrigation systems determine the modernization of agricultural activities by promoting technical innovation and emancipation of rural social networks, by inducing and dissipating the organizational behaviours and transformation of rural traditional values. As a response to the rural patrimony changes, the hydro-agricultural development generates strong agricultural zones with diverse agricultural structures and socio-ecological particularities. In these spatial economic contexts, the rural communities manage to keep food insecurity under control, to reduce unemployment, mainly in the case of male labour force, to promote rural women’s economic involvement.

Acta Universitatis Danubius : Juridica , 2006,
Abstract: In Europe, the development of alternative dispute resolution is related to many circumstances.ADR techniques are being used more and more, as parties and lawyers and courts realize that these techniques can often help them resolve legal disputes faster and cheaper and more privately than can conventional litigation. More- over, many people prefer ADR approaches because they see these methods as being more creative and more focused on problem solving than litigation, which has always been based on an adversarial model.Although certain ADR techniques are well established and frequently used — for example, mediation and arbitration — alternative dispute resolution has no fixed definition. The definition of alternative dispute resolution is constantly expanding to include new techniques.

Acta Universitatis Danubius : Juridica , 2005,
Abstract: Today we witness at spectacular transformations that the world had never known before. But these transformations led not only to significant performances but also to serious crises. The phenomenon has been qualified by the scientists with the term of globalization. Globalization has various aspects which affect the world in several different and people must understand that globalization is not only an economic phenomenon. From the beginning the globalization led to many controversies between people all over the world. Supporters of globalization argue that globalization leads to peace by diminishing the incentives for conflict, that trade creates wealth, and so on. On the other side most people who are labeled "anti-globalization" look at both the damage to the planet, in terms of the perceived unsustainable harm done to the biosphere, as well as the perceived human costs, such as increased poverty, inequality, miscegenation, injustice and the erosion of traditional culture which, the critics contend, all occur as a result of the economic transformations related to globalization. The World Trade Organization is the international organization designed to supervise and liberalize international trade and the principal supporter of the phenomenon of globalization. The European Union also is a defender of free trade and with the World Trade Organization hangs together in monitoring the international market. Dispute settlement is regarded by the WTO and by EU as the central pillar of the multilateral trading system.

Abstract: In international commercial disputes the extension of jurisdiction concerns the situation where a court extended its jurisdiction to the detriment of another abroad. Such an extension would not work but with an absolute breach of jurisdiction of other states. However, one cannot ignore the fact that art. 25 of Regulation (EC) no. 44/2001 on jurisdiction, recognition and enforcement of judgments in civil and commercial matters refers to mandatory reporting lack of competence whenever the court finds that a claim is another instance of a Member State of the Union shall have exclusive jurisdiction, text that indicate that incidental or accessory applications remain in the national court seized of the original proceedings. Although in theory it was argued that the lis pendens - related actions has no effect on international trade dispute, we can note that in relation to European Union member states lis pendens creates a special case of mandatory suspension of the case, while related actions a special case of voluntary suspension.
Alternative Dispute Resolution – Justice without Trial?

EIRP Proceedings , 2012,
Abstract: This research is proposed to analyze the alternative means of dispute resolution, as an alternativeof justice, or as a justice alternative, after studying both European critical literature and national one. Thephrase alternative dispute resolution” means any alternative way of dispute resolution method whereby two ormore people try using a third party to reach a solution to the problem that precludes them, whether it ismediation, conciliation, assisted negotiation. In this research, we proposed to use the observation as a commonmethod. We concluded that the main reason of the alternative means for dispute resolution results from thepossibility to avoid the judicial system that makes it available for the litigants. It was also shown that users ofalternative means for dispute resolution not seek to resolve the dispute outside a court as an amicablesettlement, negotiated, consensual of their dispute.

EIRP Proceedings , 2012,
Abstract: Although the e-commerce boom of the past few years has produced plenty of satisfied e-shoppersand successful Web-based companies, many consumers and businesses are left wondering where they can goto resolve their online disputes. The legal system (such as the court system and classical arbitration) cannoteffectively respond to the challenges posed by conducting electronic commerce and this paper is proposed toanalyse the types of disputes that can arise from those e-commerce operations. The aim of this approach isrepresented by our attempt to explain why conflict resolution cannot be reasonably accomplished usingtraditional legal system and consequently the measures that have been taken by the international bodies tofacilitate consumers' right to a fair and effective trial services.

Human & Veterinary Medicine , 2010,
Abstract: The diagnosis and treatment of prostate cancer often results in significant physical side-effectsand associated psycho-social stressors that can interfere with the experience of sexual intimacy forcouples. Our study aims to evaluate couple’s sexual life and to determine any potential sexual dynamicdysfunctions which could occur before and after performing classic, robotic and HIFU radicalprostatectomy as a radical therapy in prostate cancer. The present article aims at the synopticpresentation of results of a statistic research done by the author regarding the factors that influencecouple’s sex life, and also at the identification of potential dynamic disorder that could come up before aradical prostatectomy (disorders that influence the sexual prognostic following the intervention). Materialand method: the research involved 28 couples (56 individuals) and was conducted in The Municipal Clinicand in The Endoplus Clinic in Cluj-Napoca. The initial evaluation aimed to identify sexual dynamicdysfunctions before the intervention. The couples filled in an interview sheet before the intervention andwere informed about the immediate and long term effects of the intervention and of existing therapeuticsolutions. The confidentiality of interview answers has been insured and the interviews have beencollected and sealed the day of the intervention. The structure of the interview is based on the BASIC IDgrid proposed by Lazarus in 1973 which aims to establish a therapeutic action profile which would allow amultimodal intervention. All patients underwent the prostate cancer intervention as follows: 10 patientsunderwent open surgery, 9 patients robotic surgery and 9 patients HIFU therapy. Results: Each partnerof the couple was reevaluated two months after the radical therapy. The main goal of evaluating thesexual behavior was to obtain valid information in order to make the optimal therapeutic decision. Thepartner’s answer frequency for both pre and postoperator of each item of the questionnaire wascalculated. The frequencies were then comparatively analyzed according to our study’s goals. Ourresearch team’s contribution is the individualization of the grid on the respective pathology. Conclusions:The preservation of sexual intimacy is an important issue to consider, as the majority of older adultscontinue to value, engage in, and enjoy sexual activity throughout their lives. Bringing into being anorganized and individualized questionnaire is an important informative and predictive tool for outliningthe profile of the sexual life of a couple and also for making the p

Abstract: Given that from the global hat appear, one by one, new dangers, threats and risks which are destabilizing market forces, nowadays we’re seeing a pattern with non-predictable EFS (economic, financial, social) indicators. In this context, appear new paradoxes, so as the states desired to achieve a better and more sustainable networking, they found that such reaction generate, on the domino principle, other countries security. We refer here both to the military and security side and to the non military one, in order to underline the dimensions of the LRI (local, regional, international) scenarios. They are becoming more complicated and also are fighting with lack of vision for to identify, in real time, the ways to counter the micro-macro effects on the current organizational level.

Advances in Environmental Sciences , 2011,
Abstract: The study presents waste disposal problems in inconsistent conditions and their effect onenvironmental factors. We analyzed in parallel the monitoring results for 6 months, 3 months, of soil qualityin the immediate vicinity of two landfills in different locations: Aiud (Alba County) and Gura Humorului(Suceava County). At building the deposits no sealing of the platform ground was done, and also thereweren’t provided any plans to make drainage systems, sewage collection and water infiltration through thelandfill. It is discharged into the soil, thus favoring the infiltration of various pollutants. This paper aims toassess the impact of inadequate storage conditions of domestic wastes. The objective is to determine theconcentration of soil heavy metals (Pb2+, Cu2+, Cd2+ and Zn2+) so as to evaluate the degree of soil pollutionin and around landfill sites in the two localities. After the test results came, we performed tables and graphsand drew conclusions from them, regarding the variation in pollutant, points most strongly influenced by thedeposit activity and correlation of monitored parameters.
