Abstract: this article is intended to explain those changes made from the traditional concept of a contract as an egalitarian agreement between peers in order to create obligations based on free discussion between the parties, to the widely disseminated adhesion contract which governs today most markets based on the big traffic of goods and services. for this purpose, the article identifies the ideology prevailing in the environment in which encoding and regulation of contracts, classical conception contract, its posterior crisis with the emergence of widely disseminated contracts, and contractual leadership were executed; and it concludes with conceptualization of definition, functions, and juridical nature of adhesion contracts. methodology used was hermeneutics from several texts of the latina american doctrine which was used as the pattern to read national norms in force. for this, documentary information collection techniques were used, duly organized through a bibliographic system. these techniques allowed analyzing correlation of variables. variables used to develop the research were the free clause discussion contract, autonomy of private intent, and the adhesion contracts.

Abstract: Este artículo pretenderá explicar los cambios que se han dado desde laconcepción tradicional del contrato como un acuerdo paritario entre igualespara crear obligaciones, basado en la libre discusión entre las partes, hasta elcontrato masificado de adhesión, que rige hoy en la mayoría de los mercadosbasado en el gran tráfico de bienes y servicios. Para ello, se identificará laideología dominante en el contexto en el cual se dio la codificación y laconsecuente regulación de los contratos, el tipo de contrato en la concepciónclásica, su posterior crisis con la aparición de los contratos masificados y eldirigismo contractual, terminando con una conceptualización de la definición,funciones y naturaleza jurídica de los contratos de adhesión.La metodología que se utilizó fue hermenéutica a partir de los textos de ladoctrina latinoamericana que sirvió como matriz de lectura a la normativanacional vigente. Para esto se utilizaron técnicas de recolección de informacióndocumental que fueron organizadas a través del sistema bibliográfico quepermitieron el análisis correlacionado de las variables. Las variables utilizadaspara desarrollar la investigación fueron el contrato de libre discusión decláusulas, la autonomía de la voluntad privada y los contratos de adhesión.
El control a las cláusulas abusivas en los contratos de adhesión con consumidores

Abstract: Una cláusula abusiva es aquella que implica un atentado contra el principio de la buena fe en la medida en que involucra una desproporción significativa entre las obligaciones y beneficios que adquieren las partes. El Estado debe controlar la implementación de las mismas, lo cual implica una intervención en la autonomía de la voluntad privada de los contratantes, razón por la que se ha discutido en el ámbito internacional el ámbito de dicho control. Pese a dichas discusiones, es claro que el control (que puede ser legislativo, administrativo o judicial) procede cuando se presenta un contrato de adhesión con un consumidor. El control judicial que se hace de ellas puede ser a través de la declaratoria de inexistencia, de ineficacia, de nulidad absoluta o de nulidad relativa
Análisis comparativo de los grupos genéticos Holstein, Jersey y algunos de sus cruces en un hato lechero del Norte de Antioquia en Colombia

Abstract: the dairy sector in colombia has increased its development in recent years and is important in terms of its contribution to total gross domestic product. genetic groups that have the largest inventory are holstein and jersey, they have the largest volume of production and higher percentage of milk components, respectively. the aim of this study was to compare the genetic groups holstein and jersey and some of its crosses and evaluate productive, reproductive and economic performance. the study was conducted in a dairy herd located in the municipality of belmira (antioquia), which had historic production information of seven years preceding the survey. we used a total of 582 animals with 2,316 lactations distributed as follows: holstein, jersey, f1 holstein x jersey, 75% holstein and 75% jersey. the differences between the parameters productive, reproductive and economic of each genetic group were analyzed using proc glm of sas. jersey 75% animals had the highest income due to improved milk composition in terms of percentage of protein and fat, to lower production costs and the number of kids sold per year. jersey 75% of individuals should be considered when defining the racial composition of livestock holdings. these findings raise a very interesting knowledge about the genetic approach to be given to farming in colombia. however, further research is recommended to increase the reliability of the results.
Parámetros metabólicos séricos y condición corporal durante el pre y posparto en vacas Brahman: Serum Metabolic Parameters and Body Condition During Pre and Postpartum in Brahman Cows

Abstract: to describe the changes in the energy metabolism from one month prior to calving up and one month postpartum and its relation with possible body condition changes, twenty brahman cows were selected from magdalena medio, in colombia. venous blood samples (10 ml) using vacutainer? system were taken four weeks prior to calving and four weeks postpartum. glucose, triglycerides, total cholesterol concentrations, high-density lipoproteins (hdl), low-density lipoprotein (ldl), very low-density lipoprotein (vldl) and body condition (bc) were evaluated. twenty cows were distributed in two groups (1: ≤ 7 bc and 2: ≥ 8 bc). the results were analyzed using analysis of the variance and duncan test. it was observed significant reduction (p<0.05) in the glucose values and highly significant (p<0.005) in hdl lipoprotein fraction more visible in low bc cows. in addition highly significant increase (p<0.005) in ldl fraction concentrations, more visible in high bc cows. in the others parameters no were appreciated significant changes. in conclusion, brahman cows of this study showed a moderate negative energy balance that doesn?t affect the energy body reserves due to low milk production and adequate nutrition. brahman cows with loss of body condition during the experimental period (≤ 7) presented more problems to obtain energy balance.

Abstract: this is a succinct analysis of the circular relationship between health and development and the changes occurring over recent decades regarding health care services production and delivery that have resulted in a new paradigm. from the late 1970s through the 1980s, three major, worldwide shifts occurred that changed health care services in colombia and in other latin american countries: the privatization of government entities, the commodification of health care services, and the failure of the soviet model. health care system reform in colombia, considered by some experts to be a model, is an example of health care commodification that, 15 years later, has not achieved the coverage, nor the equity, nor the efficiency, nor the quality, that it should have. more so than the market, the problem has been with the market entities that seek disproportionate profits. a solution for this situation is to appeal to nonprofit organizations for the purchase and sale of health care services.

Abstract: En este artículo se estudian los conflictos en que se vieron involucrados los esclavos de la provincia de Barbacoas y los indígenas del pueblo andino de Túquerres, con énfasis en las tácticas usadas por ambos grupos, objeto de las políticas reformistas borbónicas, para comprender esa importante y poco explorada dimensión de la política de la monarquía hispánica. Al observar situaciones de crisis de las últimas dos décadas del siglo XVIII, que involucraron a esclavos e indígenas como agentes de violencia, a partir de juicios criminales, se analizan sus acciones y formas de argumentación para defender sus derechos. Las estrategias de la política popular basada en argumentos que se apoyan en la centralidad de la monarquía en la construcción de su identidad jurídica, permiten reflexionar sobre la naturaleza hegemónica del discurso monárquico y su particularidad en el contexto reformista del siglo XVIII.
