A legalidade como forma de Estado de direito

Abstract: in this paper i argue that legal state as presented by weber and kelsen cannot be identified with the rule of law, because legality is a necessary but not a sufficient condition for making it possible. the ultimate reason for this is that it doesn't solve what habermas calls the "dialectic of legal and factual equality". this paper presents three models of the rule of law, confronting them with the absolute state. these are the liberal, the democratic and the welfare state models. these regulate in different ways the relations both between the individual and the state and between individuals among themselves. undesired effects of each model are also presented and discussed. it claims that these undesired effects stem from the fact that in each case we have to do with a substantive model of the rule of law, treating the subjects as mere addressees of the law those problems are better solved by the procedural model of the rule of law proposed by habermas, because it treats the subjects of rights as makers of the law.
Apel versus Habermas: como dissolver a ética discursiva para salvaguardá-la juridicamente

Abstract: the connections between the law and morality are the clef de vo?te of law justifying problem. the philosophic preoccupation with those connections is well exemplified in the works of kant, dworkin, alexy, rawls. this paper aims to show the role discursive ethics plays in the foundation of the law, according to habermas' perspective. although habermas had established a cognitivist morality and shown an argument for the principle of universalization, it seemed to have disappeared form his later intent of juridical correction foundation. this accusation, addressed to habermas, was equally supported by apel, kettner and heck. this article intends, especially against apel's point of view, to demonstrate that discursive morality did not disappear, but have just traversed a period of conceptual modifications. indeed, for habermas, morality seems to play a negative role in the law justification process. despite this underestimation of morality, the paper defends the relevance of moral rights for this process, which increases, even more, the importance of the connections between the law and morality in the discussion of habermas' complementarity thesis.

Abstract: this article seeks to present the function that civil society fulfills in hegel and habermas. in this paper, civil society is characterized summarily, tending to the view of determining its functions. in hegel, civil society is related to the production of wealth and fulfils an organizing and educational function. in habermas, it is not related to the economics, since it is constituted by the public sphere whose function is to produce democratically legitimized contents that ought to determine the purposes of the state in terms of a system committed to realizing its purposes.

Abstract: A lei 11.684, de 2 de junho de 2008 alterou significativamente o art. 36 da Lei no 9.394, de 20 dedezembro de 1996, a LDB. é que a referida lei revogou o inciso III do § 1o, o qual afirmava que afinalidade da Filosofia e da Sociologia tinha em vista conhecimentos necessários ao exercício dacidadania, como se essa finalidade dissesse respeito apenas a essas duas disciplinas e n o a todas asdisciplinas de uma forma geral; bem como tornou obrigatórias as disciplinas de Filosofia e deSociologia. Tentar-se-á apontar no texto para uma certa concep o de filosofia, como análise deconceitos abstratos com importancia significativa para a nossa forma de vida, bem como paraconteúdos possíveis das áreas de ética e Filosofia Política, indispensáveis ao exercício da cidadania nomomento atual da sociedade brasileira, sem prejuízo para outras áreas da Filosofia, como Lógica,Epistemologia, Ontologia, entre outras, as quais também podem fazer o mesmo.

Abstract: O conteúdo normativo da modernidade fundamenta a distin o entre moral e ética, bem como, no ambito da teoria da justi a, a prioridade do justo sobre o bom. A normatividade assim concebida parte do pluralismo incomensurável de doutrinas e concep es de bem. O direito à liberdade que sustenta o edifício do consenso liberal n o é uma base suficiente para dar conta de decis es aceitáveis por todos em quest es de bioética. Por isso, duas alternativas s o possíveis, aquela de um modus vivendi entre as várias posi es e aquela processual. Sugere-se que somente esta última pode fundamentar um consenso razoável entre as diversas posi es. The normative content of modernity underlies the distinction between morality and ethics, as well as, in the theory of justice, the priority of right over the good. The normativity so conceived departs from the incommensurable pluralism of doctrines and conceptions of the good. However, the right to freedom that grounds the political liberal consensus is not a sufficient basis to account for decisions acceptable to all in matters of bioethics. Therefore, two alternatives are available, that of a modus vivendi among the various doctrines and that of a procedural position. It is suggested that only the latter can support a reasonable consensus among the various incommensurable doctrines.
A teoria discursiva da aplica o do direito: o modelo de Habermas

Abstract: O texto apresenta a teoria discursiva da aplica o do direito, tal como concebida por Habermas. Essa teoria constitui um cruzamento entre normas procedimentais coativas e argumenta o, de maneira que o procedimento juridicizado n o deve pré-julgar ou dirigir a lógica da argumenta o. No entanto, tal argumenta o n o pode ser entendida do mesmo modo que a argumenta o moral, justamente devido às honras que deve prestar à legitimidade do direito oriunda do processo democrático, cuja racionalidade, nos argumentos morais, é mais complexa do que a da argumenta o moral. Para clarificar esse ponto fundamental, é apresentada a recusa habermasiana da tese do caso especial, de Alexy. The texts presents Habermas’s theory of legal discourse. In this theory legal coercive procedures are intertwined with processes of argumentation, in such a way that those procedures should not determine the logic of argumentation. But such an argumentation cannot be understood in the same way as moral argumentation, since the rationality which makes a law legitimate is more complex than the one of moral argumentation. In order to clarify that fundamental point, Habermas’s refusal of Alexy’s special case thesis shall be exposed.
Moralidade política e bioética: os fundamentos liberais da legitimidade do controle de constitucionalidade

Abstract: O maior problema do controle de constitucionalidade - um dos institutos básicos do estado dedireito -, com rela o à sua justifica o democrática, é a chamada dificuldade contra-majoritária [countermajoritarian dificulty], já apontada por Bickel. O texto apresenta o tratamento dessa quest o em Habermas, Rawls e Dworkin, a partir da bioética, especialmente o caso do aborto, da eutanasia e da eugenia. Argumenta-se que a justifica o moral de boa parte do controle de constitucionalidade encontra sua base em fundamentos morais impostos ao legislador, a partir de uma perspectiva liberal. Tais fundamentos s o reconstituidos, tendo em vista a posi o tolerante de Locke concemente à problemática religiosa. The major problem of the control over constitutionality – one of the basic institutes of the rule of law –, with regard to its democratic justification, is the so-called countermajoritarian difficulty, already highlighted by Bickel. The article shows how this issue is tackled by Habermas, Rawls, and Dworkin, from the standpoint of bioethics, especially in matters of abortion, euthanasia, and eugenics. It argues that the moral justification of a great deal of the control over constitutionality finds its basis on moral grounds imposed to the legislator from a liberal perspective. Such grounds are reconstructed with a view to recasting Locke’s tolerant position concerning religious affairs.

En esa tarea, la sociedad civil será caracterizada, sumariamente, teniendo a la vista la determinación de sus funciones. En Hegel, la sociedad civil, se relaciona con la producción de riquezas y cumple una función organizadora y educativa. En Habermas, ya no se relaciona con la economía, siendo constituida por la esfera pública, cuya función es producir contenidos legitimados democráticamente que deberán determinar los fines del Estado en cuanto sistema comprometido con la realización de sus fines

Abstract: The study shows some reviews that Habermas made in his discursive concept of truth. Such reviews intend to give a fair treatment to the semantic question, imposed by the thesis of an identical external world, unavailable and independent of linguistical aspects; which implies an uncomfortable mode of presentation broadly accepted as linguistically in the world. The most significant reviews are summarized in what Habermas calls weak naturalism and realism without representationism. This article also analyzes the role still played, in Wharheit und Rechtfertigung, of a non-communicative use of language, as well as, the distinction between consensus and understanding. The heart of the text consists in the presentation of his revised conception of pragmatic truth, which unites the epistemic and the discursive version of truth. Finally, it makes a comparative judgment between the claim of truth and the claim of normative correction.
Marx et Adorno: la phiilosophie de l’histoire = Marx and Adorno: the philosophy of history

Abstract: L’école de Frankfort abandonne progressivement les thèses de la philosophie de l’Histoire, dont l’acceptation fournissait une espèce de fondement pour la théorie critique, dans la mesure où l’on pouvait croire aux contenus émancipateurs de la raison inclus au sein même des idées de la société bourgeoise. Nous essayerons de montrer ce qui est oublié dans les thèses de la philosophie de l’Histoire à partir de la dialectique du ma tre et de l’esclave de Hegel, et donc, pourquoi de telles thèses se sont montrées insuffisantes. Enfin, nous chercherons à démontrer que la figure théorique opposée aux thèses de la philosophie de l’Histoire se retrouve dans über den Begriff der Geschichte de Benjamin. De plus, la récupération d’un tel fondement oublié dans les thèses de la philosophie de l’Histoire détermine, vraisemblablement, la considération morale de la théorie critique habermasienne.
