Del hogar a los juzgados: reclamos familiares ante la Real Audiencia de Santafé a finales del período colonial(1800-1809)
Villegas del Castillo,Catalina;
Historia Crítica , 2006,
Abstract: the law is an important source for the historic reconstruction of the family. colombian historiography has tried to develop this kind of analysis under the premise that it is possible to identify the morality, customs and dominant institutions of the period in question, as well interpret the changes and transformations of historic processes, from the reigning norms of the period studied. these studies have brought to light the situation of women, mothers and wives in a country marked by a strong patriarchal tradition. this article, by contrast, studies the relationship between the family and the state through an examination of court cases. these sources complement the purely formal analysis, in that they allow us to identity how mothers, spouses and children used the dominant religious, moral, political and legal norms in order to defend their interests within the legal process. the court cases also helped establish the dominant models of women and men that judges of the era appealed to and defended in their judicial decisions. this article is based on an examination of lawsuits regarding food claims and opposition-to-marriage trials contained in the collection of asuntos civiles (civil matters), in the colonial section of the archivo general de la nación.
"Prefiriendo siempre á los agrimensores científicos". Discriminación en la medición y el reparto de resguardos indígenas en el altiplano cundiboyacense, 1821-1854
Del Castillo,Lina;
Historia Crítica , 2006,
Abstract: this article examines the process of privatization of indigenous reservations in new granada and argues that the process was mired in conflict. the article demonstrates how ethnic and gender discrimination sparked conflict as attempts were made to privatize indigenous reservations. the focus of the struggles for control over the privatization process was the surveyor: he who had the power to name the surveyor could -in large part- control how the privatized land parcels would be distributed. by naming surveyors trained in the national military school, the governors in bogotá consolidated their political power over privatization, legitimated a process that fomented ethnic and gender discrimination, and promoted the reputations of surveyors trained in the military school as neutral, dependable experts, despite the mistakes these surveyors also committed.

Rey del Castillo,Javier;
Revista Espa?ola de Salud Pública , 1998, DOI: 10.1590/S1135-57271998000100003
Abstract: the de-centralisation of health services in any country is a process that involves profound change. this is what has occurred in spain, where the entities that have received authority for de-centralised services (autonomous communities) are regional and have assumed political as well as administrative responsibilities within, what could be defined as, a process of "devolution". firstly, the reasons behind the spanish process are analised. the nature of the process enables it to be confirmed that it has been a result of causes non-related to the health sector, which has had to adapt to the global political change. a second feature is the coinciding of territorial distribution of authority and services with the possibility of further de-centralisation of a functional nature in the managing of health centres and services. the combination of both types of processes has enabled a large number of diversification possibilities for the spanish health system. this study refers, in quantitative terms, to the increase or decrease in differences between regions, the de-centralisation process and, therefore analises certain general qualitative effects. developing of ways to co-ordinate the health system, to be studied later, has been limited and further developments are necessary in this area. finally, future prospects of a de-centralised spanish health system are considered in relation to two principal issues: firstly, the level of difference amongst autonomous health services that is compatible with the ability to maintain health protection for all citizens thoughout spain and, as the case may be, establishing of the limits to guarantee such level; secondly, defining of the relations between autonomous health sevices in terms of co-operation and competition.

Vitae , 2011,
Abstract: after legal enaltment in the pharmaceutical profession appear two intimately related concepts: the pharmaceutical law and the pharmaceutical legislation that we should define and analyze. on the one hand, the pharmaceutical law is a heterogeneous group of dispositions regulating directly or indirectly the pharmaceutical activity. it cannot be considered an independent branch of the law, but it is possible for practical effects to order systematically the legal regulations. such is the source of a new branch inside the sanitary law, the pharmaceutical legislation, that every pharmacies most know in applied to his scientificprofessional activity which evolution is vertiginous. this paper will study this concept. from the beginning this study requires the most appropriate methodological tools. the most important one for investigation must be the desire to mark out the treated topics guided by the necessary documentation. the use methodology is the usually followed in the works of pharmaceutical legislation where the primary source is found in the diverse official bulletins publishing the legal disposition and the critical literature of the topics.
Conservación participativa en la Reserva Comunal Amarakaeri, Perú
Alex álvarez del Castillo
Latin American Journal of Conservation , 2010,
Abstract: The Amarakaeri Communal Reserve is a sacred traditional territory of the Harakmbut culture located in the Peruvian Amazon. The management and planning processes in the reserve have been based traditionally on community and participatory processes. However, current trends and the processes of hydrocarbon exploitation are turning these traditional management systems into marginalized processes with low interest and involvement from the relevant governmental institutions. We evaluate the situation from a theoretical, practical and legal point of view. We then propose a holistic perspective to approach this urgent subject in order to develop and implement management processes that avoid detrimental impacts on the community and the ecosystems in the area.
