我国信托管理人制度完善的法律思考

Abstract: 摘要  关于信托法的基本原则,在学界也是存在有一定争议性的话题。若结合信托结构、特征基本界定进行分析,保障信托目的实现应当是信托法最为重要,甚至可能是唯一的原则。由此,信托管理人在信托结构中的法律定位,以及该制度的建立、健全,则成为保障信托目的实现的重要组成部分。对于信托管理人法律地位界定问题,应结合我国信托立法与实践予以分析。将信托管理人定位于信托财产的受任人,既符合信托结构与学理要求,又能够保持法制适用的统一性需要。在明确信托管理人法律地位之后,本文主要从信托实体、程序以及功能优化等角度对信托管理人法律制度进行阐释与探讨,进而提出我国信托管理人法制完善的相关思考建议。

Abstract:
基于多孔介质的浸润过程,以电镜下所得气体扩散电极照片为例,将实际多孔介质进行网格划分,并按照一定的原则将网格化多孔介质转化为拓扑网络模型,即人工赋值构造拓扑网络技术。在小压力情况下模拟液体在多孔介质中的浸润过程。
Based on the infiltration process in porous medium, with photographs of the gas diffusion electrode in electron microscope as an example, the real porous medium is grid-divided. With certain principles, the meshing porous medium is turned into topology network model, namely artificial assignment technology. And the infiltration process is simulated in porous medium with the low pressure condition.

Abstract:
利用拓扑网络模型对有界两相平面径向流问题进行研究,不仅得到了与经典渗流力学相似的压力分布,而且获得了流动和压力分布图像,将结果直观、细致的表现出来,并对死气区及其影响因素进行了研究。得出拓扑网络模型能够很好的模拟有界平面径向流问题并有其独特的优势,而且能够拓展到其它的渗流问题,如油水两相。
Topological network model is applied in the research on bounded two-phase radial fluid flow problem. Pressure distribution is obtained by numerical modeling calculation which is similar to the classical seepage mechanics results. Furthermore, the flow and pressure distribution image is represented intuitively and vividly. The static gas zone and its influence factor are also considered. All in all, the result shows that topological network model can be well applied in bounded two- phase radial fluid flow problem simulation and has unique advantages. It can also be used to solve other problems, such as the problem of oil-water two phase.

Abstract:

随着渗流力学在各个领域的发展,很多问题需求描述细观的渗流过程例如多孔介质中气液界面的运动。本文基于多孔介质,阐述了经典渗流力学、CT扫描建模技术、逾渗理论、微观渗流仿真模拟技术和拓扑网络模型等若干方法对细观单相渗流与多相渗流的描述与解决方法,并对每种方法的特点进行总结分析,展望了发展前景。
With the development of seepage mechanics in various fields, many problems demand the flow process of micro seepage such as the movement of gas-liquid interface in porous medium. In this paper, the problems and solutions of the single phase and multi phase micro seepage based on the classical seepage mechanics, CT scanning technique, percolation theory, micro seepage simulation technique and topology network model in porous medium are expounded. Also the characteristics of each method were analyzed, and the future development was prospected.

Abstract:

本文采用拓扑网络思想,提出了一种简化的气体扩散电极拓扑网络模型,并进行数值模拟计算,得到液体从气体扩散电极一侧渗透到另一侧的液体细观分布图以及液体通过概率与介质亲水性材料比例的关系。结果表明,拓扑网络模型适合描述更细观的渗透问题。
The network topology is adopted in this paper to put forward a kind of simplified model of gas diffusion electrode. Liquid micro distribution map and the relationship between the probability of liquid getting through and hydrophilic property are obtained by numerical modeling calculation. It is revealed that how liquid penetrate medium in the graph. The result shows that the topology of the network model is suitable for describing micro permeation problem.

本文探究一种描述多孔介质的方法,将多孔介质的孔隙部分简化为由节点和管道组成的拓扑网络模型,模拟水和空气两相在介质中的渗流过程,得到流动稳定时介质中两相的分布图形,并计算出水能够透过整个介质的概率。


This paper investigates a method to describing the porous medium, which is simplifying the pore part of porous medium into network structure model consist of node and pipeline. We simulate seepage flow of water and air in porous medium through this model, obtain the figures of gas-liquid distribution when steady, and cipher out the probability of that water flows through the whole medium.

Abstract: ?以多孔材料理论为基础,以干摩擦非线性理论为依据,并结合小曲梁模型建立了金属橡胶材料的非线性本构关系,对经回火处理的金属橡胶结构进行动态试验,得到了材料的结构刚度及其系统的固有频率,将由理论模型计算出来的刚度和由实验测得的刚度进行比较,发现理论和实验吻合较好,说明由多孔材料理论建立的金属橡胶材料的非线性本构关系推导出来的刚度理论模型基本能描述金属橡胶材料的非线性刚度特性。

Abstract: 为寻找治疗肝包虫病较好的手术方法,提高治愈率,回顾性分析2002~2005年我院手术治疗的139例肝包虫患者,分别行内囊摘除、附加不同的残腔处理方法及肝包虫囊肿囊外剥除、肝叶部分切除等手术方式,比较各手术方式的效果及术后并发症的发生情况。结果139例病例均取得了较好的手术疗效。认为无论是单纯性的还是复杂性的肝包虫,必须根据患者的全身情况,病变部位有无感染、有无胆瘘、残腔大小的具体分析而采取不同的手术方式,以取得较好的手术疗效。更多还原
