Abstract:
循环经济作为一种新的经济发展方式,需要制度支撑。知识产权以“利益平衡”为价值追求,保证了循环经济发展的方向,通过理念和制度创新为循环经济提供法治保障。西部地区不仅应从正面角度,探寻利用知识产权发展循环经济的具体措施,还应从反面视角努力革除循环经济发展中的知识产权体制机制障碍,以实现知识产权制度创新和西部循环经济发展的功能耦合,实现二者的良性互动和有机发展。
Circular economy, as a new mode of economic development, needs the support of system. Intel-lectual property pursuits the value of “balance of interests” to ensure the direction of the devel-opment of circular economy, and to provide legal protection for the recycling economy through concept and system innovation. The West should not only, from the positive perspective, explore concrete measures for using intellectual property to develop circular economy, but also, from the opposite perspective, try hard to abolish institutional obstacles of intellectual property system in the development of circular economy, from which it can achieve the functional coupling of the IP system innovation and the western development of circular economy as well as the positive inte-raction and the organic development between them.
不确定跳变系统鲁棒L2-L∞滤波

Abstract: 针对既有连续时间演化,又含Markov事件驱动的一类混杂动态跳变系统,研究L22L∞性能指标下的鲁棒滤波问题,只要系统遭受的外部干扰是能量有界的,便可保证一定的预设滤波误差峰值水平.在有限时间域内定义L22L∞增益,利用随机稳定性分析获得了若干主要结果.鲁棒滤波器的分析和设计,不仅考虑了各模态下凸多面体形式描述的动态系统参数不确定性,更考虑了各模态间跳变转移概率的不确定性,使得滤波器对模态跳变机理具备了一定的鲁棒性.鲁棒滤波器的存在条件及设计方法可直接利用耦合线性矩阵不等式.最后用数值示例对结果进行了验证.
淮北市南湖湿地生态系统服务及价值评估

Abstract: ?淮北市南湖湿地是由采煤塌陷形成的,经过多年的生态恢复,已经建设成为国家湿地公园,在物质生产、净化水质、动物栖息地等方面具有巨大的综合效益。通过实地考察,针对湿地的特点,依据生态经济学的原理,运用直接市场法、替代市场法、条件价值法等多种价值评估方法,对南湖湿地生态服务的直接使用价值、间接使用价值和非使用价值进行货币化评估。研究发现,南湖湿地主要生态服务价值量总和计3544.4×104元/a(2007年不变价,下同)。其中,物质生产功能的价值最大,在南湖湿地生态系统服务价值中的比例为27%,其次是非使用价值,占总生态服务价值的25.9%。
信赖保护原则的行政法意义以授益行为的撤销与废止为基点的考察

Abstract: 信赖保护原则并非源于诚信原则,而是源自法安定性原则与基本权利规范。相对于依法行政原则而言,信赖保护原则仅在法理基础层面具有独特性,在规范适用层面则可以被法律化为依法行政原则的组成部分。从信赖基础、所期望的内容、获得保护的核心条件、提供保护的阶段与方式等方面来说,信赖保护原则不同于合法预期保护原则。我国行政许可法中并未对信赖保护原则作出规定,该原则在中国行政法中所可能具有的意义,仍然值得继续研究。
行政诉讼类型制度的功能

Abstract: 行政诉讼中的诉讼类型如何设置,与行政诉讼受案范围如何确定之间并无直接关联,因此诉讼类型制度不具有拓展受案范围的功能。从完善诉权保护的角度来说,虽然可以考虑引入无效性确认之诉、继续确认之诉与预防性诉讼三种诉讼类型,但不可高估其意义。我国现行行政诉讼制度中系以非明文规定方式建立了类型制度。是否明文规定诉讼类型仅具有形式意义上的区别,不会对行政诉讼制度的具体构造形成实质影响。改良行政诉讼制度应着力推进实质意义上的诉讼要件制度的完善,不能寄希望于明文规定的类型制度的构建。
科技开发区发展预测模型及其应用

Abstract: 本文应用系统工程中的有关预测理论和预测技木,对近年来在我国兴起的科技开发区和新技术产业开发区的发展状况进行了分析,首次建立了科技开发区发展预测模型,提出了模型中两个动态变量的处理方案;并应用模型,对重庆市沙坪坝科技产业开发试验区今后几年的主要发展指标进行了预测。此发展预测模型可广泛用于新技术产业开发区、科技开发区以及其他类似社会经济系统未来发展状况的预测。

基于基因水平研究乳酸乳球菌的有氧呼吸代谢

Abstract: 本研究旨在对能和不能有氧呼吸代谢的乳酸乳球菌呼吸链基因同源性和细胞色素氧化酶活力进行分析,为确定乳酸乳球菌的有氧呼吸必要条件奠定基础。首先,分别测定已筛选到的菌株KLDS4.0325和KLDS4.1102在发酵和有氧呼吸代谢时的生长曲线;其次,提取KLDS4.1102的基因组DNA,随后利用PCR扩增其呼吸链编码基因并进行DNA测序;最后,从GenBank数据库下载KLDS4.0325的呼吸链编码基因序列,利用DNAMAN软件比较这两株菌呼吸链编码基因的同源性,并测定这两株菌的细胞色素氧化酶活性。结果表明在有氧呼吸条件下KLDS4.0325的生物量和pH都显著增大,而KLDS4.1102在两种条件下呈现一致的生长趋势,呼吸链编码基因的同源性分析显示KLDS4.1102具备完整的呼吸链,而酶活测定结果却显示KLDS4.1102无细胞色素氧化酶活性,这表明KLDS4.1102不能进行有氧呼吸代谢不是由于编码基因缺陷造成的,可能是某些编码基因不能正常表达,导致其细胞色素氧化酶不能正常发挥作用。
The homology of genes coding for respiratory chain and cytochrome oxidase activity of Lactococcus lactis strains that can or cannot undergo aerobic respiration were compared to provide a foundation for determining the necessary conditions for aerobic respiration in Lactococcus lactis. Firstly, growth curves of the two selected strains, KLDS4.0325 and KLDS4.1102, were determined under fermentation and aerobic respiration conditions. Secondly, the genomic DNA of strain KLDS4.1102 was extracted, and its respiratory chain-encoding genes were amplified by polymerase chain reaction (PCR), followed by DNA sequencing. Finally, the sequences of genes coding for the respiratory chain of KLDS4.0325 were downloaded from the GenBank database, the homology of genes coding for the respiratory chain in the two Lactococcus lactis strains was compared by DNAMAN software, and the cytochrome oxidase activities of these two strains were determined. The biomass and pH of KLDS4.0325 undergoing aerobic respiration increased significantly, but KLDS4.1102 presented a consistent growth trend between the two physiological conditions. The homology analysis of the genes coding for respiratory chain of two strains showed that KLDS4.1102 possessed a complete respiratory chain, while cytochrome oxidase activity could not be detected in KLDS4.1102. This finding suggests that KLDS4.1102 cannot undergo respiratory metabolism normally, possibly because some gene cannot be expressed normally, leading to abnormal cytochrome oxidase function.
重采样条件互信息构建基因调控网络算法研究

Abstract: 基因调控网络的重构可以挖掘出基因之间潜在的调控作用关系,帮助我们更深刻地理解复杂的调控机制,在系统生物学中,这已经成为人们研究的一个热点问题。现在已经产生了大量推断网络构建的模拟理论和计算方法,其中一些信息论方法在计算中容易遗漏一些调控关系,这些调控关系可能代表基因间真实的调控关系。为了克服这个缺点和进一步提高网络重构的精度,本文提出了一种新的基因调控网络构建方法,它通过重采样和加权平均策略,利用条件互信息来进行基因调控网络重构。算法首先从基因表达数据中重采样得到一系列子数据,然后通过条件互信息方法构建一系列子数据的网络,最后利用这些子网络加权平均得到最终的基因调控网络。本文的算法在DREAM3模拟数据和SOS真实网络数据上进行验证,和其它一些流行的方法相比,本文提出的网络重构算法取得了较高的精确度和准确度。
Reconstruction of gene regulatory networks (GRNs) from large-scale expression data can mine the potential causality relationship among the genes and help understand the complex regulatory mechanisms. It is of utmost interest and has become a challenging computational problem for understanding the complex regulatory mechanisms in cellular systems. For the past decades, numerous theoretical and computational approaches have been introduced for inferring the GRNs. However, all existing methods of inferring GRNs from gene expression profiles have their strengths and weaknesses. In particular, many properties of GRNs, such as topology sparseness and non-linear dependence, are generally in regulation mechanism but are seldom taken into account simultaneously in one computational method. Some information theory algorithms do not recover the true positive edges that may have been deleted in an earlier computing process. These interaction relationships may reflect the actual relationship of genes. To overcome these disadvantages and to further enhance the precision and robustness of inferred GRNs, we presented an ensemble method, to infer GRNs from gene expression data by adopting two strategies of resampling and arithmetic mean fusion in this work. In this algorithm, the jackknife resampling procedure was first employed to form a series of sub-datasets of gene expression data, then the conditional mutual information was used to generate the corresponding sub-networks from the sub-datasets, and the final GRN was inferred by integrating these sub-networks with an arithmetic mean fusion strategy. Compared with those of the state-of-the-art algorithm on the benchmark synthetic GRNs datasets from the DREAM3 challenge and a real SOS DNA repair network, the results show that our method outperforms significantly LP, LASSO and ARANCE methods, and has a high and robust performance.
两阶段优化在水库调度图中的应用研究

Abstract: 水库常规调度图按时段出水位确定该时段出力(或出流)决策一般不考虑径流预报,但在水库实际调度中则可利用入库径流预报来提高水库的运行效率。本文基于水库两阶段优化问题,在分析目标函数单调性的基础上,将两阶段优化的理论应用于水库调度图中,并以三峡水库为研究背景,按照原设计调度图和两天预报结果,进行水库调度的优化运行。结果表明:较原模拟结果,优化后可增加年均发电量19.47亿KW·h,显著提高了水库的运行效益。
Generally, inflow forecast is not concerned when using conventional operating rule curves to calculate the output (or outflow) based on initial water level. While in real reservoir operation, inflow forecast can be added to improve the operation efficiency. Based on the reservoir two-stage optimization problem and the analysis of the monotonous of the objective function, the two-stage optimization theory is applied to the reservoir operation rule curves in this paper. With the case study of Three Gorge Reservoir, in accordance with initial operating rule curves and two days inflow forecast, the optimal operation of the reservoir is obtained. It is shown that: compared with the initial simulation result, the proposed method improves the hydropower greatly.
