On the Rural Land Consolidation Procedure Legislation’s Perfection in China

Abstract: The rural land consolidation procedure legislation’s scientific degree is lower in China; it can’t guide the rural land consolidation process systematically and normatively. The integral research on legislative practice includes two aspects, i.e., legislative system and legislative content. To do the theoretical research based on legislative text is the most relevant research methods. To perfect the rural land consolidation procedure legislation in China by the formulation or modification of relevant legislation is very necessary and possible. Key words: Rural land consolidation; Procedure; Legislative system; Legislative content Résumé Le dipl me scientifique de la législation foncière rurale de la procédure de consolidation est le plus bas en Chine, il ne peut pas guider le processus de consolidation des terres rurales systématiquement et normativement. La recherche intégrée sur la pratique législative comporte deux aspects, à savoir, le système législatif et le contenu législatif. Pour faire de la recherche théorique basée sur le texte législatif est des méthodes de recherche les plus pertinents. Pour parfaire la législation foncière rurale de consolidation procédure en Chine par la formulation ou la modification de la législation pertinente est très nécessaire et possible. Abstract: this article evaluates the influence of the decentralization of the constituent work in the formation of the 1988 constitution. we note that the plenary was less crucial for the agenda of the constituent than several authors proclaim. the inclusion of public policies in the constitution occurred mainly during the phase of commissions, under the aegis of progressive leaders, having been deepened in the trading floor. the article shows, therefore, how preference outliers in the step of constituent committee determined much of the constitution adopted in the end of 1988.

Abstract: The object of the article is to study the first phase in the reform of federalism, which came into force on 1 Sept 2006 and that, based on the numerous constitutional reforms undertaken since the creation of the Federal Republic of Germany, has led to reorganization of the system to distribute competences between Bund and L nder. After studying the ultimate causes of the reform, the author analyses the procedure to carry it out, the work by the Commission on federalism and the culmination of the reform after the general elections. After considering both the achievements as well as the matters not resolved by the reform, the author concludes that one may not consider a clear winner has appeared due to the changes enacted and he is also critical about some results of the reform, especially in the field of competences and, in particular, in relation to the new competence technique, that allows the Bund and L nder to issue regulations on certain matters that successively substitute those of the other body.
The Determinants of Control of Commission s Executive Functions

Abstract: The aim of this article is twofold. First, I review the political science literature on delegation and control and apply the control side of agency theory to the activities of the Commission. Second, I test McCubbins and Page s (1987) propositions on the determinants of control. I then conclude with some comments on the impact of these procedures on Commission s autonomy, with reference to other works on the subject. Hypothesis: McCubbins and Page suggest that the stringency of ex post control is positively correlated with 1) conflict among legislators and 2) uncertainty about the benefits and costs of the policy. Methods: I use logistic regression and a cumulative logit model that test the hypotheses on a stratified sample of non amending secondary legislation adopted from 1987 to 1998. Results: Unanimity rule, conflict between Community institutions and uncertainty about the costs and benefits are key determinants for the establishment of ex post procedural control of Commission s implementation activities. Conflict and uncertainty are also important factors affecting the degree of stringency in control.

Abstract: 摘 要: 立法语言审查程序乃是一项对立法语词、句式、篇章结构等文本表达进行审查的立法程序。管窥韩国“语言审查程序”的立法实践可知,该程序在纠正语言错误、提高立法质量、实现法律的规范性和确定性上已经凸显出十分积极的效果。反观我国的立法语言运用现状,立法语言失范现象层出不穷且日益严重。因此,伴随“科学立法”“民主立法”的提出以及《立法法》修改之契机,我国立法机关应当在借鉴韩国“语言审查程序”的基础上,设立立法语言审查主体,明确语言审查的内容,并建构一套完整的立法语言审查程序,以保证立法的质量。
Abstract: Legislative language checking procedure is to check the literal expressions, such as words, sentences and chapter structures in legislation. A look into the legislative experience on language checking procedure in South Korea shows positive effect on correcting language faults, improving the qualities of legislation and realizing the normalization and accuracy of law. However, in Chinese legislative language utilization, irregularities are increasingly serious. Therefore, with the opportunities of the proposition of “scientific legislation”, “democratic legislation” and the modification of Legislative Law, our state legislature should take measures as follows on drawing the experience from South Korea: set a legislative language checking subject, clarify the contents of language checking, and construct a set of integrated legislative language checking procedure. These measures can ensure the quality and normality of legislation

Abstract: The article presents some ideas aimed at making the Parliament of Cataloniaa more central institution in the political process. After analysing the possiblemeaning of the expression "crisis of parliaments” in modern societies,the legal amendments to the new Statute and Regulations of 2005 are setout in terms of modernising parliament. However, in terms of this objective,there are still problems to be resolved and opportunities for action. The authorspropose some measures which may be controversial, which include areduction in the number of deputies, a strengthening of representativescompared to groups, the employment of non-legal professionals, an activecommunication policy and multidisciplinary parliamentary studies.

Time to Decide: The effect of early agreements on legislative duration in the EU

Abstract: The increased use of early agreements in the EU co-decision procedure raises the concern that intra and inter-institutional political debate is sacrificed for the sake of efficiency. We investigate the effect of early agreements (trilogues) on the time it takes for legislation to be negotiated during the first reading of co-decision. We find that the first reading negotiations of trilogues on salient legislation take longer than first readings of similar files reconciled at second and third reading. First readings of early agreements also appear to last longer when considering all co-decision files submitted to the 5th and 6th European Parliaments, but the effect is masked by a general increase in first reading duration after 2004. We conclude that even if early agreements restrict access of certain actors to decision making, they allow for more time for substantive debate at the first reading stage than similar files reconciled later in the legislative process.
