Modernismo, historiografia e sociabilidade intelectual: apontamentos sobre o quinto volume da cole??o Biblioteca Histórica Brasileira (1931-1940)

Abstract: this article is in the background thinking the trajectory of the book memórias de um colono no brasilthe swiss immigrant thomas davatz, the fifth volume published by the brazilian historical library collection, based on the discussions of the field of intellectual history. to this end, the text is divided into parts. first, take into account the circulation of the book between the modernists and its repercussion in the press through articles published in diário nacionalin 1931. then i analyze a small set of letters received by sérgio buarque de holanda where you can see the difficulties in the translation and publication of the work year after the collection. in the letters there is still evidence of the construction of a national history project that greatly resembled that of the historical and geographic brazilian institute (ihgb).

Abstract: the article focuses on the analysis of the new cultural places raised within contemporary society, which affects musical expressions attached to aboriginal cultures in chile. the article claims that, next to the socio-aesthetical diasporas of indigenous musical performance, a parallel shift is being produced, from ritualistic places to spaces where no artistic expressions had been before hypermodernity. this reconfiguration of space is a new challenge to ethnomusicology because nowadays, not only the study of new forms of ethnic art in an intercultural context is required, but also the inclusion of the anthropological place. this modifies the aspects (and specters) of oral art and relocates the researcher in a new coordinate, the ?non-place?.
O ICM na importa??o mediante arrendamento mercantil

Abstract: the main purpose of this study is to understand the tax incidence on the circulation of goods (icm) related to imports, particularly those conducted by leasing. the federated states and the federal district have always aimed to make the taxes collection of any imported goods, regardless of the legal business nature done outside the country. however, these states' practice has generated a discussion in the judiciary, as the taxpayers have protested against these charges. almost all the doctrine believes that icm will just focus on importation - but only if in this operation the imported goods ownership transference takes place. this understanding is based on the fact that the importation is only an icm impact extension. for this reason, it should be bounded to the constitutional law of this tax. it is also important to emphasize the existence of a minority doctrine position, which believes that the icm of importation is a new incidence of tax (icm), granted to the federal states and the federal district by the constitutional legislator, adding the impact of taxes on any and all input of goods from abroad. due to this positioning of the doctrine is that states have the legal support to make the collection of tax on any import transaction, regardless of whether or not there is transfer of ownership of the goods upon importation. however, the supreme court has dismissed the collection of the tax when in the import operations do not occur a transfer of ownership of the property, as in contracts for imports through leasing. in these contracts, the products imported by leasing remain within the property of the lessor, and the lessee only has the immediate possession of the property. in other words, in these operations the transfer of ownership of the property does not occur, consequently, there isn't the incidence of icm in these operations.

Abstract: this paper aims to clarify the relation between art and reconciliation in herbert marcuse's thought, according to some of his writings concerning the subject. these works employ the term "reconciliation" with two meanings: it means the possibility of effectuating within material relations the sublimed cultural themes and this would result in the disappearance of the art; on the other hand, it means the image of a harmonic world which art preserves in itself and that stays away from social order. under this aspect, art remains utopia.

Abstract: chronic obstructive pulmonary disease (copd), mainly caused by smoking, is predicted to be the third most frequent cause of death in the world by 2020. it is a multicomponent, progressive, disabling condition that ultimately ends in respiratory failure and death. there is evidence that systemic inflammation and extra pulmonary effects are also common in copd, although the association between systemic inflammation and systemic manifestations of copd is still not entirely clear. copd is not only preventable but also treatable and the past decade has witnessed great progress in copd research. new drugs have been developed and tested and a growing base of scientifc evidence now documents the efficacy of several therapies for symptoms and exacerbations. it is clear that many patients with the disease can beneft from an aggressive management, with a decrease in the frequency of hospitalizations and improvements in symptoms and quality of life. moreover, basic and clinical scientists have now identifed cells, mechanisms, and molecules that play key roles in its pathogenesis. the advent of newer and more effective therapies will lead to a decline in the contribution of this disease to worldwide disease burden. copd is now viewed under a new paradigm as preventable and treatable.

Abstract: Este artigo tem como pano de fundo pensar a trajetória do livro Memórias de um colono no Brasil, do imigrante suí o Thomas Davatz, o quinto volume publicado pela Cole o Biblioteca Histórica Brasileira, com base nas discuss es do campo da História Intelectual. Para tanto, o texto é dividido em duas partes. Primeiro, levo em conta a circula o do livro entre os modernistas paulistas e sua repercuss o na imprensa a partir dos artigos publicados no Diário Nacional em 1931. Em seguida analiso um pequeno conjunto de cartas recebidas por Sérgio Buarque de Holanda, em que é possível perceber as dificuldades enfrentadas na tradu o e publica o da obra, anos depois, pela Cole o. Nas cartas, verificam-se ainda indícios da constru o de um projeto de história nacional que em muito se assemelhava à do Instituto Histórico e Geográfico Brasileiro (IHGB). SENSIBILIDADE ESTéTICA E SENTIMENTO RELIGIOSO NA FILOSOFIA DE MAX HORKHEIMER'S (pelos trinta anos de morte de Horkheimer)

Abstract: Pretende-se investigar a estética e a religi o na filosofia de Max Horkheimer, enquanto instancias de crítica à ordem estabelecida e à imagem de uma sociedade possível ainda n o realizada. Mesmo n o tendo desenvolvido um pensamento estético de grande envergadura, como foram os casos de Adorno e Marcuse, suas esparsas considera es sobre a rela o entre arte e sociedade coincidiram, durante longo período, com as de seus dois colegas do Instituto de Pesquisa Social. Ou seja, a arte autêntica é conhecimento e crítica à sociedade estabelecida. Por sua vez, a religi o, embora seja um sentimento verdadeiro, é posta em um nível inferior e concebida como refúgio para os miseráveis, dentro da tradi o marxista na qual o filósofo se inserira inicialmente. Ao final da vida, porém, Horkheimer pareceu mais inclinado a considerar que, no mundo administrado, apenas o sentimento religioso cumpria a condi o de imagem de um mundo inteiramente outro. As raz es para essa mudan a de perspectiva podem ser buscadas na sua avalia o tardia sobre a rela o entre arte e sociedade.

Abstract: Pragmatismo é um movimento filosófico que inclui aqueles que afirmam que uma proposi o é verdadeira se funciona de forma satisfatória, que o significado de uma proposi o pode ser encontrado nas conseqüências práticas de aceitá-la, e que as idéias pouco práticas devem ser rejeitadas. O Pragmatismo come ou no final do século XIX, com Charles Sanders Peirce (Como tornar nossas idéias mais claras, Fixa o da Cren a) e foi desenvolvido na obra de William James (Peirce e James eram membros do Clube Metafísico). O pragmatismo tem uma idéia principal: a verdade é mutável. Este artigo é uma discuss o teórico-conceitual sobre o direito de crer, a partir da filosofia pragmatista de William James. O artigo inicia com uma breve discuss o sobre a religi o, em seguida, discute a posi o de Nietzsche e, por fim, discute-se a perspectiva da filosofia americana pragmatista criada por Charles Peirce e William James. Palavras-chave: Religi o; Pragmatismo; Filosofia; Morte de Deus Abstract Pragmatism is a philosophical movement that includes those who claim that a proposition is true if it works satisfactorily, and that the meaning of a proposition is to be found in the practical consequences of accepting it, and that unpractical ideas are to be rejected. The Pragmatism began in the late nineteenth century with Charles Sanders Peirce (How to Make Our Ideas Clear; The Fixation of Belief) and it was developed further in the works of William James (Peirce and James were members of The Metaphysical Club). The Pragmatism has a major idea: truth is mutable. This article is a theoretical-conceptual discussion about the right to believe, from the perspective of pragmatist philosophy of William James. The article begins with a brief discussion about religion, and then discusses the position of Nietzsche and, finally, the perspective of American philosophy created by the pragmatist Charles Peirce and William James is discussed. AUTONOMIA PRIVADA E DIREITOS DA PERSONALIDADE – PERSONALITY RIGHTS AND PRIVATE AUTONOMY

Abstract: Os direitos da personalidade s o inerentes à condi o humana e, como tais, s o irrenunciáveis e intransmissíveis. No entanto, além da renúncia e da transmiss o, existem outras formas de disposi o, que devem ser admitidas. O sujeito n o pode transmitir o direito propriamente dito, mas pode ceder o exercício e até consentir na sua les o, em situa es excepcionais. Para tanto, em primeiro lugar, a vontade há de ser livre, sem influências de condicionamentos externos, e deve ser manifestada por um sujeito capaz de discernir, que esteja devidamente informado sobre as consequências dos seus atos. Além disso, para ser eficaz, o ato de disposi o deve promover a dignidade da pessoa humana. Do contrário, desde que n o seja ilícita, a conduta poderá até ser protegida pelo ordenamento jurídico a título de manifesta o positiva da liberdade individual, mas n o receberá san o positiva nem negativa. PALAVRAS-CHAVE: Rela es existenciais. Dignidade da pessoa humana. Liberdade individual. Consentimento informado. ABSTRACT: Personality rights are inherent to the human condition and therefore are non-renounceable and not transferable. However, besides renouncement and transmission, there are other ways of disposal, which must be accepted. The person cannot transmit the right itself, but may transfer the exercise and might consent to its injury, in exceptional situations. Firstly, it is required a free will, with no influence of external constraints, and must be a decision manifested by a subject able to discern, properly informed about the consequences of his actions. Furthermore, to be effective, the act of disposal must promote human dignity. Otherwise, unless it is illegal, the conduct is likely to be protected by law as a positive manifestation of individual freedom, but will not receive a positive or negative sanction.
