Free or Limited Dismissal by Enterprise Owners in Germany—A Classic and Authoritative Discussion  [PDF]
Jianhong Fan, Qing Tian
Beijing Law Review (BLR) , 2013, DOI: 10.4236/blr.2013.44023
Abstract:

Multinational corporations pay great attention to the dismissal caused by enterprise owners (Arbeitgeberkündigung), especially in the fierce competition of market economy. In fact, the limits of dismissal rights of employers are also a key issue in human resources management. However, the importance of solving this problem reasonably is beyond the law itself. Once the rationality of the premises that are based on the legislation of dismissal limits is challenged, the solution drawn from deduction or induction becomes an issue of ambiguity. This paper will discuss the concept of “dismissal”, its differentiation with other related concepts, and the concept of dismissal limits from the perspective of German law. The study also discusses the following issue from the view upon legal theory: Are the dismissal’s “premises” of legislation and judicatory rational? This study also sheds lights on the comparative law in some developing countries.

Qing Zhou, Qiuyan Huang, Hong Tian
Creative Education (CE) , 2013, DOI: 10.4236/ce.2013.412A1006
Abstract:

Task-Based Learning (TBL) is a student-centered, teacher-guided and task-performed teaching approach. This study was aimed to investigate the effects of task-based learning (TBL) in chemistry experiment teaching on promoting high school students’ critical thinking skills in Xi’an, China. To achieve the aims, a pre-test and post-test experimental design with an experimental group and a control group was employed. Students in the experimental group were taught with TBL, while students in the control group were taught with lecturing teaching methods. Five chemical experiments were selected, and 119 students aged at 17 - 19 voluntarily participated in the research which lasted one semester. The California Critical Thinking Skills Test (CCTST) was used as a data collection tool. Results showed there was an obvious significant difference (p < 0.05) in the dimension of analyticity in the experimental group after TBL, while there were no significant differences in the total score, the evaluation and inference of CCTST. The findings provide an effective way for chemistry teachers to improve students’ critical thinking analyticity skills.

International Journal of Geosciences (IJG) , 2012, DOI: 10.4236/ijg.2012.32042
Abstract: The climate change in Shandong Peninsula, China was analyzed in this paper by the non-parametric Mann-Kendall test, Accumulated Difference Curve and Order Cluster Analysis methods, based upon the datas of annual mean, maximum and minimum temperature and annual precipitation, precipitation from June to September over the past 50 years. Results obtained showed a number of observations: 1) The annual mean temperature of Shandong Peninsula showed a significant increasing trend, with a distinct abrupt change point detected around 1990, during the past 5 decades. The warming of the Peninsula over the last 50 years was due mainly to the significant increase of annual minimum temperature. The annual maximum temperature demonstrated a mixed trend of decreasing and increasing, but was statistically insignificant, and no abrupt change was detected; 2) The annual precipitation exhibited a decreasing trend during the past 5 decades, with an abrupt change detected around 1980 at most stations; but there was an earlier transition point at 1966, at a few stations. The reduction in precipitation, from June to September, was responsible mainly for the decrease of annual precipitation. Besides, the proportion of the June-September precipitation in the year declined slightly over the last 50 years; 3) In comparison, the temperature evolution in Shandong Peninsula was basically consistent with most parts of China, but warmed at a faster rate over the same period; the decreasing trend of precipitation was more significant compared with the other climate zones of China. Within the Peninsula, the abrupt change of temperature and precipitation in the Southeast was earlier than that in the Northwest; the reduction of precipitation was larger in the Southeast while the increase of temperature was more significant in the Northwest. This research was of great importance to understand the climate change and its environmental effects in the coastal zone.
FP-Growth Algorithm for Application in Research of the Basket Analysis
Qing Tian,Yongmei Liu
Transactions on Computer Science and Technology , 2013,
Abstract: During the process of mining frequent item sets, when minimum support is little, the production of candidate sets is a kind of time-consuming and frequent operation in the mining algorithm. The FP growth algorithm does not need to produce the candidate sets, the database which provides the frequent item set is compressed to a frequent pattern tree (or FP tree), the frequent item set is mining by using of FP tree. For the sake of researching the Basket Analysis, the Frequent-Pattern is introduced, Visual C++ is applied to design the program to mine the frequent item sets. In view of the frequent K-item set, the various results are contrasted, the goods which is sell possibly at the same time in the supermarket is arranged in the same place.
On the uniqueness of the foliation of spheres of constant mean curvature in asymptotically flat 3-manifolds
Jie Qing,Gang Tian
Mathematics , 2005,
Abstract: In this note we study constant mean curvature surfaces in asymptotically flat 3-manifolds. We prove that, in an asymptotically flat 3-manifold with positive mass, stable spheres of given constant mean curvature outside a fixed compact subset are unique. Therefore we are able to conclude that there is a unique foliation of stable spheres of constant mean curvature in an asymptotically flat 3-manifold with positive mass.

Natural Science (NS) , 2010, DOI: 10.4236/ns.2010.22019
Abstract: In this paper, clear liquid fermentation condition for ethanol production from Canna edulis Kerl with orthogonal design was studied. We have studied five factors that influenced clear liquid fermentation condition for ethanol production from Canna edulis Kerl by the single-factor test. The five factors were α-amylase amount, glu-coamylase amount, pH, nitrogen and auxiliary materials amount. Selected the best amounts of α-amylase, glucoamylase, pH, nitrogen source and auxiliary materials by means of the singe- factors test. And then, we used the Orthogonal test to optimize the fermentation process. The study showed that the best fermentation condi-tions were α-amylase amount 7 u/g C.eduli, glu-coamylase amount 145u/g C. edulis, pH 4.4 and the amount of urea 0.08%, 1% of rice bran as auxiliary materials. The rate of alcohol which was produced by the best fermentation conditions is 21.5% that increased by 1.3% than the rate of alcohol by the single-factor test.

Theorem to Generate Independently and Uniformly Distributed Chaotic Key Stream via Topologically Conjugated Maps of Tent Map
Zheng guang Xu,Qing Tian,Li Tian
Mathematical Problems in Engineering , 2012, DOI: 10.1155/2012/619257
Abstract: This paper proposes a theorem to generate chaotic key stream from topologically conjugated maps of Tent Map. In this theorem, the condition for topological conjugation between Tent Map and a class of chaotic maps is first determined. Then, the chaotic attractor of the maps is divided into unequal subintervals, the chaotic orbit is sampled once in time iteration, and, finally, the independently and uniformly distributed phase key stream is obtained. The theoretical and numerical analyses show that the chaotic key stream generated by the proposed theorem successfully is independent and uniform, has a certain complex degree close to the maximum approximate entropy for 2n phase key stream, and satisfies the randomness requirement defined in NIST SP800-22. This theorem can be used in fields such as cryptography and numerical simulation.
Ab initio calculation of the growth of Te nanorods and Bi2Te3 nanoplatelets

Tian Xiao-Qing,

物理学报 , 2008,
Abstract: In this paper the growth mechanism of a Te/Bi$_{2}$Te$_{3}$ novel structure is studied by \textit{ab-initio} calculations. The results show that the growth of Te nanorods is determined by the adsorption energy of Te atoms on different crystalline Te surfaces. The adsorption energy of Te on the Te (001) surface is 3.29 eV, which is about 0.25 eV higher than that of Te on the Te (110). This energy difference makes the preferential growth direction along the $<001>$ direction. In addition, the higher surface energy of Bi$_{2}$Te$_{3}$ (110) and the lattice misfit between crystalline Bi$_{2}$Te$_{3}$ and Te along $<001>$ direction are considered to explain the growth of the Bi$_{2}$Te$_{3}$ nanoplatelets, in which Volmer--Weber model is used. The theoretical results are in agreement with experimental observation.
