信息披露质量影响资本配置效率实证检验

Abstract: 文章以深市上市公司2003-2012年的数据为样本,从行业和公司两个层面实证检验上市公司信息披露质量对资本配置效率的影响。研究发现:信息披露质量的提高可显著增加行业和公司的资本投入增长率对其资本产出增长率的灵敏程度,使资本更快地实现由低效率领域向高效率领域的转移,从而提高资本的配置效率。
The effect of information disclosure on capital allocation efficiency is verified with data of A-share companies listed in Shen Zhen Stock Exchanges from year 2003 to 2012. We find that with the increase in the information disclosure quality, the reaction of investment alteration to its capital output alteration becomes more sensitive, which means that information disclosures with higher quality promote capital transfer rapidly from lower returning fields to higher returning fields, thus realizes the efficient allocation of capital.

Abstract: 大数据时代,数据已成为社会生产和经济发展的关键要素,个人信息在提高政府决策水平、企业精准营销、社会管理创新等方面具有巨大的潜在利用价值。纵观全球,以欧盟为代表的个人信息保护单行立法模式成为当前世界各国的主流做法。国际社会在个人信息的界定上基本形成了以可识别性为核心判定标准的共识;但个人信息界定的动态性和场景性不仅带来了司法认定上的困难,也使企业在匿名化处理问题上所适从。充分借鉴国外立法,以加强个人信息权顶层设计为核心,通过事前同意、事中风险评估和事后个案认定机制来弥补个人信息界定的固有缺陷,是提升中国未来民法典人格权编和个人信息保护法科学性的应有之义。
In big data era,data has become a key element in social production and economic development,and there is enormous potential value in personal information in improving government decision-making,enterprise's precision marketing,innovation of social management and so on. Globally,the legislation of personal information protection law represented by the European Union has become the mainstream practice in the international community. As for the definition of personal information,the international community has basically formed an approach based on identifiability. But the dynamicity and contextual nature of the definition of personal information not only leads to the difficulty of judicial application,but also makes the enterprise not be able to deal with the problem of anonymization appropriately. In order to make up for the inherent defects of personal information definition,it is necessary to take full advantage of foreign legislation,strengthen the top-down design of personal information rights and construct a prior consent,risk evaluation and case-based mechanism,which constitute the proper meaning of promoting the rationality of civil code and personal information protection law in the future.
预应力CFRP布及预紧螺栓加固RC梁试验研究

Abstract: 为提高碳纤维布加固RC结构的效果及其可靠性,提出了预应力碳纤维布与预紧螺栓联合加固技术。结合在役RC梁的损伤特点及目前的RC梁加固方法,分别采用不同的碳纤维布加固技术对完整梁和破坏梁的抗弯性能进行了对比试验研究。针对目前碳纤维布张拉设备的缺陷,研发了便于现场应用的新型碳纤维布布张拉设备,分析了预应力大小对加固效果的影响。结果表明,预应力碳纤维布及预紧螺栓联合加固技术是一种更可靠的桥梁加固方法,不仅能够提高RC梁正截面的抗弯承载能力及正常使用阶段的截面刚度,而且螺栓预紧锚固碳纤维布能够很好地抑制其在混凝土表面的剥离,提高碳纤维布与混凝土表面之间粘结强度,对碳纤维布施加预应力能够充分发挥其高强性能,有效抑制混凝土裂缝开裂和开展。
To improve the strengthening effect and reliability of concrete structure strengthened with carbon fiber sheets, a new hybrid bonding pre-stressed carbon fiber sheets technique is developed. This technique combines the pre-stressed carbon fiber sheets with mechanical fastening of pre-screwed bolts. In accordance with the fracturing characteristics and the strengthening method of aging RC beam bridges, different carbon fiber sheets strengthening technology were applied on the intact and destructive RC beams. And a series of experiments were conducted to examine and assess the flexural performance of RC beams. Then, a new type of tensioning equipment was invented to meet the need of tensioning carbon fiber sheets in practical engineering. The experiment results show that the hybrid bonding pre-stressed carbon fiber sheets is a more reliable strengthening technique which can not only improve the flexural capacity and the section stiffness of RC beams during normal use stage, but also can increase the cohesive force between carbon fiber sheets and concrete interface. It can make full use of the tensile strength of carbon fiber sheets and can restrain the opening and developing of the cracks.
改进粒子群算法的两阶段梁式结构损伤识别
Two-stage beam structure damage detection based on improved particle swarm optimization

Abstract: 针对实际工程监测时损伤识别误差大的问题,提出一种基于改进粒子群算法的两阶段识别方案。第1阶段利用D-S证据理论融合算法进行损伤定位;第2阶段利用改进的粒子群算法,对定位结果进行修正,同时准确定量损伤。仿真算例和实验分析结果表明:由于第1阶段损伤定位减少了可能损伤单元的数量,第2阶段基于改进粒子群算法的搜索范围减小,能更准确地识别多损伤和小损伤的位置和程度,且抗噪性能良好。
Considering large errors of damage identification during actual monitoring process, a two-stage detection method based on the improved particle swarm optimization(PSO)algorithm was proposed. The algorithm is then used to detect the structural damage locations preliminarily,and to validate the locating results and determine the damage extents precisely. The comparisons between the simulation and experiments show that the first phase of damage identification reduced the number of suspected damage locations, making the search domain of the second stage based on the improved particle swarm optimization algorithm significantly reduced. The presented two-stage recognition method can identify the damage locations and detect the damage extent precisely for multi-damage and small damage,with considerable capacity in anti-noise.
信息熵未确知测度理论在混凝土再生粗骨料质量优选中的应用
Quality optimization of concrete recycled coarse aggregate based on information entropy and uncertainty measurement theory

Abstract: 随着中国城镇化建设进程的加快,建筑垃圾的产量将越来越多,再生混凝土的应用不仅能够解决建筑废弃物日益增多的难题,而且可以节约大量的砂石资源。为了对混凝土再生粗骨料质量进行排序和优选,基于信息熵-未确知测度理论构建了混凝土再生粗骨料质量评价模型。根据《混凝土用再生骨料标准》确定评价指标体系和单指标测度函数;利用信息熵理论确定各指标的权重,依据各个指标的样本实测结果计算单指标测度评价矩阵和多指标测度评价向量;按照置信度识别准则进行质量等级评判并应用实例分析检验该方法的有效性。结果表明,信息熵未确知测度理论不仅可以对单个样本进行质量等级评价,还对评价结果处于同一级别内的样本质量的好坏进行排序。
With the acceleration of China's urbanization drive, construction wastes are on the rise. The application of recycled coarse aggregate could reduce the increasing construction wastes and save abundant sand resources. In order to sort and optimize the quality of recycled coarse aggregate, the quality evaluation model of recycled coarse aggregate is established based on the information entropy theory. The evaluation index system and single-index measurement functions are determined on the basis of Recycled Coarse Aggregate for Concrete. The weights of these indices are obtained from the information entropy theory. The evaluation matrix of single-index measurement and multiple-index evaluation vector are calculated according to the field data. The quality grade is assessed with credible recognition criteria. An analysis instance is shown, which verified the effectiveness of the proposed model. The result shows that the information entropy and uncertainty measurement theory can be applied to quality evaluation of single sample and distinguish quality of the same grade.
律师庭外言论的规制——兼论《刑法修正案(九)》泄露案件信息罪

Abstract: 发表庭外言论是律师采取的一种诉讼策略,意在通过塑造公众舆论影响庭内裁判结果。《中华人民共和国刑法修正案(九)》将律师庭外不当言论入刑不仅在刑法哲学上有违谦抑性要求,在法律文本上也存在不符合罪刑法定原则等问题。为维护法律的权威性,中国对律师庭外言论的规制,一方面应通过法律解释、“但书条款”和管辖回避构建防止滥用泄露案件信息罪的三道防线;另一方面应借鉴美国律师协会对律师庭外言论采取的限制与保护并举的规制措施,在保障律师言论自由的基础上,对发表造成严重后果和恶劣影响言论的律师施以资格罚。
Publishing extrajudicial statements is a litigation strategy adopted by lawyers to shape public opinion then affect trial results. Penalty of lawyers' inappropriate statements in Criminal Law Amendment (Ⅸ) violates the modest restraint of criminal law, and does not comply with the principle of legality. To safeguard the authority of law, a defense system composed of legal interpretation, "notwithstanding clause" and jurisdiction avoidance should be constructed to regulate lawyers' extrajudicial statements. Also, American Bar Association's restriction and protection measures should be learned to protect lawyers' freedom of expression and meanwhile impose qualification penalty on lawyers whose inappropriate statements cause serious consequences and adverse effects.
基于先验信息的供水管网阻力系数识别

Abstract: 供水管网阻力系数识别是指通过调整管网水力模型中管道阻力系数,使模型计算值与监测值相符的过程。由于实际中监测点数量有限,管网阻力系数识别为欠定的优化问题。现行方法通常采用管道分组这一参数化方法将欠定问题转换为超定,应用遗传算法或其它随机搜索算法求解。提出了基于先验信息的供水管网阻力系数识别算法,所提出算法根据管道管材、管龄等先验信息对管道阻力系数进行估计,并将估计值作为伪观测值引入目标函数将欠定优化问题转换为超定,采用高斯-牛顿算法进行求解。与现有方法相比,所提出算法避免了管道分组不唯一的问题;再者,推导了供水管网阻力系数雅克比矩阵解析式用于搜索向量构造,提高了参数识别计算效率。采用小型管网阐明了雅克比矩阵计算及搜索向量构造,利用大型管网验证了算法的实用性。
Pipe resistance coefficients (PRCs) identification of water distribution systems (WDSs) is a process of adjusting the PRCs in hydraulic model of WDSs to make its predictions consisting with measurements. Because the number of monitoring sensors is limited in practice, the identification of PRCs of WDSs is an under-determined optimization problem. Existing methods tend to use a parametric method of pipe grouping to convert the under-determined problem to over-determined, and then solve it using GA or other stochastic searching algorithms. This paper presents a prior information based algorithm for PRCs identification of WDSs. In the proposed method, the PRCs are estimated previously according to prior information of pipe material and pipe-age, and then used as pseudo observations introduced into objective function to convert the under-determined optimization problem to over-determined one, and the Gauss Newton algorithm is utilized to solve it. Compared to existing method, the proposed algorithm avoids the non-uniqueness problem of pipe grouping; in addition, the analytic formula of Jacobian matrix of PRC is deduced for searching vector construction, which improves the calculation efficiency of parameter identification. A simple network was used to illustrate the calculation of Jacobian matrix and the construction of search vector, and a larger network was utilized to validate the practicability of the method.
