Cybercrime and the Law: An Islamic View  [cached]

Abstract: E-crime today presents one of the major challenges to law enforcement. Information technology is facing waves of laws guarding the interest of people using the Web technology. These laws were derived from the common laws and legislations applied in general crimes. With over one billion Muslims in this world, several calls were raised in the Islamic countries to establish a law suitable to handle computer crimes which matches the Islamic Shar'iah law. In this research, we have analyzed the 'Adellah' ( ) (Shar'iah Evidences of Quran, Hadith and Imams sayings) to verify the outlook of Islam in computer crime. We propose an introductory computer crime law from an Islamic point of view which we believe will initiate further research in this important field.

These laws were derived from the common laws and legislations applied in general crimes. One of these laws is the law of the state is Texas in the United States in 1985. In a world which has more than one billion Muslims, it is time to consider proposing a law that is in line with their teachings. Several calls were also raised in the Islamic countries to establish a law suitable to handle computer crimes which matches the Islamic Shar`iah law. The main question to ask here is how can the Islamic law which was established in the seventh century handle crimes resulting from the use or abuse of the new technology and provide suitable laws for the protection of its computer users. To answer this question our research has analyzed the Adellah () (Shar`iah Evidences of Quraan, Hadith and Imams sayings) that match Texas computer crime law items to verify the outlook of Islam in computer crime. We set out to prove that computer crime with its high technology is not entirely a new type of crime that needs a new Islamic theory and thus is already covered by the general Islamic Shar`iah laws. Based on the available computer crime laws and our understanding of the Quranic verses, we propose to tackle this very difficult area by proposing a computer crime law from an Islamic point of view. We believe this research is the first of its kind and will open the discussion in this important area with the exception of one study which addresses the e-commerce from an Islamic view point.
The Permissibility Status of Plant Biotechnology from the Islamic View

Abstract: The development of modern biotechnology has the potential to enhance the quality of the industrial, medical and agricultural sectors worldwide. However, it has created a divisive debate globally on its positive and negative impacts. The objective of this study is to assess the permissible status of interspecies gene transfers in plant biotechnology from the Islamic perspective. This study involved the identification and interpretation of the verses from al-Quran and quotations from al-Sunnah and the analysis of other relevant Islamic sources. The permissible status of food derived from plant biotechnology according to the Islam perspective must fulfill the concept of halalan tayyiban. Halalan tayyiban refers to the permissible status of food in relation to Syariah or the Islamic law. There are two important parts in determining the status of halalan tayyiban for plant biotechnology products the beginning process (input) or the gene sources and the final process (output) which refers to the direct or indirect impact of the final products to the five objectives of syariah. In conclusion from the Islamic point of view, the development of modern biotechnology is permitted if the inserted genes are taken from halal (permissible) sources and at the same time it does not cause any harmful effects to the five objectives of syariah.
Euthanasia in Cancer Patients, Islamic Point of View

Abstract: Background: Euthanasia is an important subject that concerns law and medicine as well as morality and religion in the 21St century. Euthanasia has become a challengeable problem in scientific arena. In some countries, legal and medical practitioners are allowed to kill those cancer patients who suffer from excessive pain while incur enormous amount of expenses for their treatments.Methods: We used 3 main sources to find Islamic views on euthanasia: First, the Islamic primary source, the Holy Quran, which is the most important and reliable source for finding Islamic perspectives. Second, traditions (hadith) which include Prophet Mohammad's and his relatives's (Imams) advices. Third, religious opinions and decrees (Fatwas) from great Muslim scholars who are called Mofti Al-Aazam in Sunni tradition and Ayatollah Al-Ozma in Shiite tradition. Results: Based on the reasons proposed in the references, it can be concluded that euthanasia is forbidden in Islamic theology; and no types of euthanasia are allowed or accepted in Islam; and any action whether voluntary or involuntary that results in euthanasia of cancer patients is considered suicide and is strongly forbidden in Islam. Conclusion: Euthanasia is purely illegal in Judaism, Christianity, and Islam. In this study, we introduced a religious law based on Islamic point of view and Emamyeh section in Islam. To investigate the sensitive issue of euthanasia in Islam, the Holy Quran as the fundamental reference of Islamic law and Sonnah as the reference of Hadith (Traditions) were studied.

Abstract: The rapid progress of science and technology, including genetic research and technology has been led to new hopes in the treatment of some genetic conditions and diseases. But these developments have also raised ethical and societal concerns in different communities. Certainly, medical genetics knowledge should be applied so, we have to maximize its benefits and minimize any harm. In recent decades, many attempts have been performed by scientists, ethicists, jurisprudents and lawyers for compiling international and national guidelines for regulation and legislation in this field. "nFor compilation of this article, we searched some comprehensive electronic databases and some valid English and Farsi books and journals. In this intensive review, we intend to provide a basic knowledge about genetic ethics for health care professionals in order to facilitate their decision-making in clinical practice."nThere are various ethical issues related to medical genetics that we reviewed in this paper in brief. These key issues do need attention and urgent resolution universally. We also reviewed Islamic view of points in this regards and finally we addressed the status of genetic ethics in our country, containing new national guidelines in this field.

Abstract: The purpose of the present paper is to study the possible application of marketing to promote religion in the specific case of “Islam”. In fact, marketing techniques have been adapted to religious goals since the beginning of the 19th century. But with the rise of the secularization movements in the post-modern era, its application becomes vital to guaranty the survival of religions notably in the Christian case. Islam is facing the same difficulties, such as the decrease of mosque attendance, the decrease of religious commitment, xenophobia and Islamophobia. Our approach was to study marketing application such as defining the 4P’s for the religion of Islam. This would be done based on marketing science and the Islam’s sources: The Holly Quran and Prophet Mohamed (PBUH) Hadiths. In the case of Islamic religion’s sources, and specially in Holly Quran and Prophet Mohamed (PBUH) Hadiths we found many similarities with marketing strategy notably in the choice of promotional variables and the insistence on the importance of religious promotion or Islamic Daawah. So we suggest that the use of marketing techniques is possible and would have two major purposes: Developing Islamic religiousness and repositioning Islam’s image as an opened, tolerant and modern religion.

Abstract: The meltdown of financial markets across the world is one of the most common characteristics of modern capitalist economy. Starting with the stock market crash of 1901 through the great depression of 1930s to the Black Monday of 1987, the Asian financial crisis of 1997 and finally the latest tsunami of global financial crisis, the history of major stock market crashes are undoubtedly a testimony of its nature. According to IMF, the world has witnessed more than 100 stock market crisis in last 30 years. However, with the endeavors of so many talented academicians, policymakers, and researchers the reasons behind these crashes still remain unexplored. After almost 25 years nobody has a solid answer to the reasons behind stock market crash in 1987. Meetings after meetings, summits after summits, conferences after conferences of the world leaders, thinkers and academicians in the form of DAVOS summit, G-8 summit, EU summits, G-20 summits etc. have failed miserably to identify the root causes behind the crisis. At times the expectations of finding a common solution to the problem from such high level summits have ended up with common blame-games while the crisis continues to multiply as various economies enters into much painful long term recessions with human stories of sufferings, job loss and even suicide. Therefore, this article aims at uncovering the root causes of repeated form of global financial crisis by critically investigating the philosophical and functional foundations of existing system of financial economy. A detailed review of fundamentals, methods and facts about capitalism clearly highlights the inevitability of such problem to exist in existing financial economic model in the light of Islamic economic system.

Abstract: Determination of legal rulings in Islam on food that has been modified DNA is very difficult. This is because the Muslim jurists themselves have different opinions in their legal decisions to determine the foods that have been modified DNA by modern processes or well-known as istihalah in Islamic legal system. Therefore, it seems that the Muslim contemporary jurists always do an effort to solve the problem of food based on evidence taken from the Quran and the Traditions of the Prophet. Thus, the objective of this study is to identify the istihalah process that is of a major importance factor in transforming DNA of food, changing the unclean substance to the new products that benefit consumers. In addition, this study also seeks to examine all views of Muslim jurists in determining the legal ruling of istihalah. In addition, the study also provides a mechanism for the determination of the legal ruling in Islamic law, especially in the case of istihalah that produces a good product for publics. This study uses qualitative methods through instruments of data collection and content analysis based on comparative method. The findings of this study indicate that all products will be evaluated based on the final products. If the final product does not have any unclean substance, the law permits to consume it. Otherwise, it is unlawful.

Abstract: Some of the assumptions of cosmology, as based on the simplest version of General Relativity, are discussed. It is argued that by slight modi?cations of standard gravitation theory, our notion of the sources of gravity {the right hand side of Einstein's equations{, could be something radically di?erent from what is usually expected. One example is exhibited to prove the point, and some consequences are discussed.

Abstract: In this essay we discuss the difference in views of the Universe as seen by two different observers. While one of the observers follows a geodesic congruence defined by the geometry of the cosmological model, the other observer follows the fluid flow lines of a perfect fluid with a linear equation of state. We point out that the information these observers collect regarding the state of the Universe can be radically different; while one observes a non-inflating ever-expanding ever-lasting universe, the other observer can experience a dynamical behaviour reminiscent to that of quintessence or even that of a phantom cosmology leading to a 'big rip' singularity within finite time (but without the need for exotic forms of matter).
