Spatial and environmental planning of sustainable regional development in Serbia  [PDF]

Abstract: The paper analyses the planning framework for sustainable territorial and regional development. The spatial and environmental planning should play the key role in coordination and integration of different planning grounds in achieving the sustainable regional development. The paper discusses the spatial planning capacity to offer the integral view of the sustainable territorial development. The brief review of tendencies in new spatial planning and regional policy has been given. The focus is on the concept of balanced polycentric development of European Union. The guiding principles of spatial planning in regard of planning system reform in European countries have been pointed out. The changes in paradigm of regional policy, and the tasks of European regional spatial planning have been discussed. In Serbia problems occur in regard with the lack of coordinating sectoral planning with spatial and environmental planning. Partly the problem lies in the legal grounds, namely in non codification of laws and unregulated horizontal and vertical coordination at all levels of governance. The possibilities for the implementation of spatial planning principles and concepts of European Union sustainable territorial and regional development have been analyzed on the case of three regional spatial plans of eastern and southeastern regions in Serbia. The disadvantages in implementing the strategic environmental impact assessment as an instrument for coordination and integration of sectorial planning with spatial and environmental planning have been analyzed. The strategic environmental impact assessment has been implemented only in the spatial planning process. Through spatial planning process its feedback effect on sectorial planning has been indirectly achieved. The priority actions in Serbia for achieving the spatial and environmental planning role in coordination and integration of different planning grounds in sustainable regional development have been given.

Abstract: The paper presents an overview of the expected role of spatial and environmental planning in coordination and integration with strategic planning for sustainable spatial/territorial, landscape and tourism development. The application of an integrated approach to sustainable territorial development planning and management in the European Union is also analyzed in the context of problems associated with and possibilities to enhance the European Landscape Convention and Agenda for a sustainable and competitive European tourism implementation. We have analyzed the contributions of reforms that have so far been implemented in current legislation and of planning bases to the establishment of coordinated sustainable territorial development planning and management in Serbia and to the procurement of support for the integration of sustainable tourism development and landscape planning and management into the process of spatial, environmental and sectoral planning. The approach to and problems of landscape protection and sustainable tourism development occurring in the practice in spatial planning are analyzed through examples of a new generation of spatial plans - the Spatial Plan of the Republic of Serbia, and a spatial plan of the special-purpose area for the Nature Park and Tourism Region of Stara Planina Mountain. Through the example of Mt Stara Planina, the role of strategic environmental assessment in coordination with spatial and sectoral planning is analyzed, as well as potential contribution to landscape integration and sustainable tourism development in the process of planning. The possibilities for better coordination of Serbian strategic planning in achieving the sustainable spatial and tourism development, and possibilities to integrate landscapes into the planning process are indicated.
Implementation of strategic environmental assessment in Serbia: Case of spatial plan of Kolubara lignite basin

Abstract: Although considered as an important tool for environmental evaluation of plans and programmes, inclusion of strategic environmental assessment (SEA) in Serbian legislation was inevitable as a part of the accession process to the European Union. The first part of this paper will focus on presentation of the SEA system in Serbia and its implication as the result of current geopolitical and environmental trends. Taking into consideration the economic importance of the mining regions, but also the damage to the surrounding environment, in the second part of this paper the authors will try to review the significance of SEA implementation in spatial planning of Kolubara lignite basin.

Abstract: The paper presents an overview of experiences of public participation within planning, summarized in the "ladder of citizen participation". Further, considering that Strategic Environmental Assessment (SEA) is seen as an instrument for operationalizing the sustainable development strategy, the stress is on the place, role and scope of public participation in SEA within planning. Special attention is given to the status of SEA regarding public participation in planning in Serbia. One of the conclusions of the paper is that by introduction of the "Plan for public participation" as a legal obligation, it could be the way for operationalizing pubic participation and further, enhancement of participation in planning. .
Some problems of integrating the landscape planning into the spatial and environmental planning in Serbia

Abstract: A short review has been given of Serbian spatial and environmental planning, and in particular of relevant legislation. Attention has been paid to the landscape treatment within legislative grounds, and correspondingly in planning practice. Few assumptions have been made, upon the lack of methodological and integrated approach to the landscape protection and management. Strategic plans (spatial and town master plans), sectoral plans and policies (for soil, forestry etc) have been reviewed in attempt to verify the stated assumptions. The problems of landscape and open green space protection and maintenance have been brought up. In reference to the EU recommendations, legislation and instruments have been investigated regarding the entrenchment of the landscape concept and landscape planning into the spatial, environmental and related sectoral planning. Prior to the landscape concept implementation is the survey and establishment of regional landscape diversification so as to differentiate regional approaches to landscape planning.

Abstract: Strategic environmental Assessment (SEA) is a decision support instrument for predicting and evaluating the likely environmental effects of implementing a policy, plan or programme. SEA can consider the cumulative impacts of more than one project or activity on the same environmen- tal component. This paper discusses the analysis of cumulative effects in SEA, with reference to spatial planning by: providing a review of key concepts and methods related to cumulative effects literature; presenting a rationale for the inclusion of cumulative effects in SEA of spatial plans; advancing a proposal to address cumulative effects in different SEA stages. The paper concludes that SEA offers the opportunity to support a better management of cumulative effects arising from many local-level spatial planning decisions. Three aspects emerged as critical to ensure good practices: the selection of valued environmental components, the adoption of future-oriented approaches, and the use of spatially-explicit information.

Abstract: Protection, improvement and rational utilization of the environment becomes more and more primary task in modern society's struggle for more ecological healthy and humane living and working conditions. In order to living conditions satisfy man's social, economic, health and other needs protection, improvement and utilization of the environment must be in accordance with principles of sustainable development. Fact that planned solutions have great influence on quality of some environmental elements imposes importance of spatial planning for providing healthy environment as one of basic human needs. As in many planning documents environmental aspect was not considering in the way that it was needed to be, there arose a need for Strategic Environmental Impact Assessment in aim to verify are the planning documents in coherence with environmental protection and sustainable development.
Introducing strategic environmental assessment in Serbia with special reference to the European Union directive and infrastructure corridors

Abstract: In July 2001, the European Union (EU) adopted the Directive 2001/42/EC of the European Parliament and the Council of 27 June 2001 on the Assessment of the Effects of Certain Plans and Programmes on the Environment, known as the Strategic Environmental Assessment (SEA) Directive. The EU countries will have three years, until July 2004, for the integration of the SEA Directive into national laws. The SEA Directive introduces procedural and technical requirements, according to which environmental assessment is compulsory for certain plans and programs but not for policies, except if they are a part of a plan, as well for plans and programs of national defence, civil emergencies, finance and budgets. According to the scope of the SEA Directive, environmental assessment is compulsory for plans and programs for infrastructure corridors – transport, telecommunication and energy systems. In addition to the overview of the general framework for Strategic Environmental Assessment and the main requirements of the SEA Directive, the current situation in Serbia regarding the present condition of SEA is presented with special reference to the infrastructure corridors. One of the conclusions of this paper is that the main limitation for the implementation of SEA for plans and programs covering infrastructure corridors is the current legal situation. The main law which is supposed to introduce SEA has not been adopted yet, while the scope of the SEA within the new Planning and Construction Act includes SEA only for urban plans and does not cover, among others, plans for infrastructure corridors.
Strategic environmental assessment and climate change in the Republic of Serbia: Support to development and adjustment process  [PDF]

Abstract: The paper analyzes the SEA status in the Republic of Serbia in the context of climate change problem. In addition to an overview of current legal framework, status and relationship towards the planning process, special attention has also been dedicated to the analysis of current practice - the SEA of plans of different hierarchical levels - for the purpose of giving insight into the current state. The paper stress that the development of the SEA in Serbia has stagnated since the introduction of the Law on Strategic Environmental Impact Assessment ( Official Gazette of the Republic of Serbia“, no.135/2004 and 88/2010) in the sense that there are no special activities in innovating methodological and procedural framework, nor public participation initiatives. Further, results of research that has been carried out indicate that climate change problems have not been systematically treated in the SEA, i.e. in plans, and that the existing legal framework is not fully supportive of this problem area. Based on the results, the recommendations have also been formulated which, amongst other things, include the formulation of special guidelines for carrying out the SEA which would, in particular, treat climate change in the sense of instructions related to phases of planning, level and coverage of plans including also examples of good practice, as well as strengthening of institutional framework and permanent education.

Abstract: The present article analyzes the concept of strategic environmental assessment (SEA) and its role in the development of local transportation strategies and plans, investigating how SEA acts as an effective tool to integrate environmental issues into transportation planning. The paper provides with useful advice for local authorities on how to comply with the European and national legislation requirements in the environmental permitting process for transportation plans. At the same time, it points out useful information for practitioners in the field of the strategic environmental assessment in the elaboration of the Environmental Report, as the key factor in SEA procedure.
