Abstract: Aderarea Romaniei la Uniunuea European la 1 ianuarie 2007 a determinat schimbari majore in legislatia cu privire la contractele de concesiune si la parteneriatele publice-private. In acest context, au fost emise o serie de noi prevederi legislative cum ar fi Ordonanta de Urgenta a Guvernului nr. 34/2006 privind atribuirea contractelor de achizitie publica, a contractelor de concesiune de lucrari publice si a contractelor de concesiune de servicii, si Ordonanta de Urgenta nr. 54/2006 privind regimul contractelor de concesiune de bunuri proprietate publica. De asemenea, Leaga 544/2004 a litigiilor administrative include contractele incheiate de autoritati publice, contractele care urmaresc valorificarea bunurilor publice, executarea de lucrari in interes public, servicii publice si achizitii publice; prin legi speciale, alte categorii de contracte ale administratiei publice pot constitui subiecte juridice pentru litigii administrative. In mod sigur, legislatia si prevederile legislative actuale demonstreaza importanta contractelor administrative - percepute ca un aspect inseparabil de parteneriatele publice-private - ca fiind niste instrumente prin care vietile indivizilor si a intregii comunitati sunt influentate in mod pozitiv, fara a afecta bugetele publice in mod negativ.

Abstract: Lucrarea se doreste a fi o analiza exploratorie a nevoii de formare profesionala din cadrul institutiilor publice locale din Regiunea de Nord-Vest a Romaniei. Prezentul studiu incerca nu numai sa evidentieze principalele elemente si factori care influenteaza nevoia de formare profesionala si sistemele de pregatire profesionala, dar si sa creioneze imaginea reala a procesului de pregatire si dezvoltare profesionala. De asemenea, acest studiu va evidentia faptul ca unul dintre obiectivele masurarii performantelor profesionale anuale ale functionarilor publici este identificarea nevoii de pregatire profesionala.

Abstract: The Romanian Administrative Code represents the main outcome of the project “A more coherent legislative framework for a more efficient public administration”, financed through the Operational Programme for the Development of the Administrative Capacity and implemented by the Central Unit for Public Administration Reform within the Ministry of Administration and Internal Affairs. The public services field is one of those fields considered for inclusion in the Administrative Code. In this context, taking into consideration the insertion in the Administrative Code of the criteria for the classification of public services, particular relevance is attributed to the distinction in the community legislation and practice between the services of general economic interest and the non-economic services of general interest, given its impact on the application of European Union rules on state aid, public procurement and internal market.

Abstract: Needs assessment in local public institutions was not very present so far in a systematic manner in Romanian specialized literature on administrative reform. Current study uses interviews with candidates for a public administration master program to investigate civil servants motivation of pursuing graduate-level studies and their perception on current needs of the work in local public institutions. Motivation for pursuing graduate studies is located mainly on the need to update and diversify their professional knowledge, and not as much on promotion-related reasons. The perceived needs are related to management of public institutions, structure of information system, legislation and European integration, human resource management and public relations.

Abstract: Scopul principal al acestui articol consta in oferirea factorilor de luare a deciziilor a unor informatii detaliate cu privire la procesul de planificare a dezvoltarii economice locale. Cercetare utilizeaza ca metodologie analiza secundara a datelor ce provin de la Institutul National de Statistica a judetului Gorj. Cercetarea evidentiaza principalele tendinte ce se manifesta in judet cu referire la fenomenele care influenteaza dezvoltarea economica locala: consumul, piata muncii, sectorul de afaceri etc. De asemenea, autorii analizeaza programele implentate la nivelul judetului, scopul carora consta in promovarea dezvoltarii economice locale si regionale. In final, autorii mentioneaza o serie de bariere ce exista la nivelul judetului si impiedica dezvoltarea economica, precum si o serie de masuri menite sa adreseze aceste provocari.

Abstract: Estonia is situated on the southern buried slope of the Baltic Shield where the sedimentary bedrock overlies the Precambrian crystalline basement. The Cambrian section contains mainly sandstone and clay (e.g. famous “blue clay”), Lower Ordovician is represented by sandstone, including phosphate Obolus sandstone (shelly phosphorite), and Upper Ordovician by oil shale (kukersite). Estonia is not very rich in useful minerals, but we have some georesources sizeable in European context: oil shale (the Estonia deposit is the largest commercially exploited and best-studied oil shale deposit in the world), phosphorite (the well-studied Rakvere deposit is the largest phosphorite deposit in Europe, but not exploited), and peat (Estonia is considered as a country richest in peatlands in North Europe). Unfortunately, for more than 80 years oil shale and phosphorite have been mined and industrially used in environmentally hazardous ways, devastating large regions in northern and northeastern Estonia. The mining is mainly causing technological and technical, environmental, economic and social problems.

Abstract: With the arrival of formerly Soviet-dominated Central Eastern European countries in the EU, the conceptualisation of European security was yet again challenged, this time by different perceptions of old threats, instead of different readings of modern threats. The evolving (Western) European security culture has tended to address the challenges stemming from beyond EU’s borders, while, in this process, the new EU member states brought with them security concerns sprung from within EU’s borders and EU’s taboo neighbourhood (Russia). Romania was such a country, which, in spite of fully subscribing to the Western perspective on (rather politically neutral) modern threats, also displayed a conservative ‘territorial defence’ attitude rooted in its recent adverse history and compatible, to a great extent, with American conceptions of security matters. Lessening the European East-West mismatch over defining and addressing Europe’s security challenges may occur through a process of asymmetrical adaptation to each other’s security concerns, though this mismatch may equally endure over time and even generate centrifugal forces at the heart of EU’s security policy-making.

Abstract: The classic approach of the health system analysis is based mainly on the duality of the health systems, divided between the public and the private health sectors. The studies undertaken in the field of health sector financing in the last decades have concluded that in reality the health systems are not characterized by the duality of the services, but rather by a “tetrality” of sectors. Today, especially in Central and Eastern Europe, the health sector can be divided in four sub-sectors: the public-, the private-, the “formal public and private mix”- and the “informal public and private mix” health care sectors. The latest studies have shown that in Romania, informal payments are significant and persist over time / constant. The main problem caused by the existence of informal payments in the health sector is that the effects of health policies implemented by the government are and will be marginalized. The main objective of this study is to highlight the possible causes (financial, economic, political) that have led to the development and the constant growth of such financial contributions. Furthermore, based on causal model we will try to identify the possible solutions and their effects in order to minimize the problems generated by the informal payments.

Abstract: This article refers to the rapports between the Parliament, as legislative power, and the radio and television public services. These rapports are part of the tasks of the parliamentary control function, which is exercised by the Legislative power and they regard the legislative competences in the assignment of management procedure, the parliamentary control over their financial-budgetary activity, as well as over the activity reports over the services presented to the Parliament. One of the major challenges is that of providing a real independence and autonomy for the public radio and television in the conditions of the tendency of the Parliamentary power structure to be reflected at the service management structure level.

Abstract: The paper studies the constant and continuous concern for how speed - through high-speed train - influences rail joints, which in turn contributes to urban competitiveness, by improving quality transit area. Also, because rail station building quality and safety are enforced by the European Union, this paper brings into attention a lot of observations on Romanian railway buildings architecture. Unfortunately, in Romania there are no equivalent high-speed tracks, the rail network is partly electrified, with no flagship technology. In fact, new national upgraded lines do not employ 20th century engineering. With no elimination of constrictions such as at-grade crossings, no upgraded buildings and with no range of quality services for passengers, Romanian railway accumulates deficiencies over a period longer than twenty years.
