Monopoly of State-Owned Enterprise of Social Justice

Abstract: The role of the state through BUMN becomes so important when it is formulated in a provision as formulated in Article 33 Paragraph (2) of the 1945 Constitution of the State of the Republic of Indonesia, where the production branches which are important for the State and which affect the livelihood of the public must be controlled by Country. Here it indicates the authority of the State to participate in economic activities through the operation of production branches that can be categorized as important for the State and considered vital and strategic for the interest of the State.This is based on the reasons as formulated in the explanatory section of Article 33 of the 1945 Constitution of the State of the Republic of Indonesia, so that the benefits of the production branches do not fall into the hands of individuals, the State actively takes the role to cultivate it because the production branch is considered important and which control the livelihood of the people for the greatest prosperity of the people. State-Owned Enterprises is formed with the aim of contributing to the development of the national economy in general and the state's revenue in particular; The pursuit of profit; To hold general benefit in the form of providing goods and / or services of high quality and adequate for the fulfillment of the livelihood of the public; Pioneering business activities that have not yet been implemented by the private sector and cooperatives and actively providing guidance and assistance to weak economic entrepreneurs, cooperatives, and communities.SOEs are given the right to monopoly in the economic field which is considered to control the livelihood of many people.

Abstract: 摘要 社会主义市场经济体制的性质决定了国有经济与民营经济不应是相互排斥的,而是可以共同发展的,关键是确认它们在各自适宜发展的领域发挥作用。本文从产品性质及行业特性两个维度来客观制定功能导向的分类方法,以此来对不同类型的国有企业选择不同的改革模式。即提供公共产品的国有企业宜选择国有国营模式,垄断性国有企业宜选择国有国控模式,竞争性国有企业一部分宜进行产权多元化的股份制改造,一部分宜实行民营化。在分类改革原则下推进国有企业的混合所有制改革,在公共产品领域推进“长期导向”下的混合,在自然垄断领域推进“控制权导向”下的混合,在竞争性领域推进“流动性导向”下的混合,同时构建与国企分类改革战略相适应的国有资产监管体制。在利益相关者合作逻辑下,分类分层推进国有企业治理结构的创新,并分类构建国有企业经营者的激励机制。

The Necessity of Anti-Piracy and Anti-Monopoly in Software Industry

Abstract: The piracy and monopoly in the software industry is analyzed in this article which shows that they will ultimately endanger the national industry but not the foreign monopoly enterprises. The author considers that the low price of the pirated software and the internets monopoly form are the two reasons to form monopoly. Anti-pirate and anti-monopoly are both imperative ways to develop Chinese software industry. A general strategy regulation in the software industry elicited by this article is to strike piracy in the protected period, shorten moderately protection period of the software product and limit the monopoly manufacturers to some extent.
Research on Influencing Factors of Executive Compensation in China’s Monopoly Industries  [PDF]

Abstract: The annual salary income of the executives in the state-owned monopoly industry has become the focus of the society recently. With the improvement of enterprise efficiency, executives deserve to get high pay. However, it’s should be noted that because of the state-owned monopolies’ special status, business performance relies heavily on administrative monopoly power, but not actually the efforts of leaders. In this case, the income distribution mechanism is distortion, which has caused great dissatisfaction. This paper aims to study the main affecting factors of the executive compensation of state monopolies, with 1280 firm-year observations of 183 monopoly companies. We find that 1) Executive compensation is positively correlated to firm performance, firm size, CEO duality; 2) Executive compensation is negatively correlated to state share proportion and independent director proportion; 3) Company location, industry both have significant influence on executive compensation.

Abstract: 摘要 本文从产业发展政策和自然垄断领域的规制政策两个角度,分析了国有企业在产业政策实施中的积极意义,探讨了目前产业政策所存在的问题,并提出了相应的政策建议。研究表明,国有企业在保证产业发展战略的实现和对自然垄断产业的规制中具有积极作用;在产业发展战略的实施中,应慎重把握行政性干预和市场机制之间的平衡,实现政企分开,侧重于创造鼓励创新的制度环境;在自然垄断行业中,应区分竞争性环节和自然垄断环节,并侧重于通过机制设计和价格管制限制自然垄断环节的市场势力。
Abstract: From the perspective of industry development and natural monopoly, this paper studies the role of stateowned enterprises (SOEs) and problems of current industry policies. The analysis shows that SOEs play positive role in the implementation of industry development strategies and the regulation in natural monopoly industry. Strategies of industry development should balance administrative intervention and the market, separate government functions from enterprise management, and establish institutions that encourage innovation. In natural monopoly industries, policies should distinguish natural monopoly sector from competitive sector, and focus on limiting market power in the former one through mechanism design and price regulation.

Abstract: Industrial segmentation of the labor market is an important factor which causes the wage inequality in China’s urban labor market. This paper aims to investigate the determinants which help people entering monopoly industry by building a logistic model using CHIP data. The results show that the workers’ education, work experience and age are more helpful for labor entering monopoly industry in China’s urban labor market. Compared with the local residents with the same human capital, the probability of the floating population entering the monopoly industry is much smaller. Abstract: In view of the allocation of cash flow rights and control rights in venture capital firms, a financing contract model is set up by introducing the entrepreneur’s self-owned capital in this paper. This paper analyzes the affecting factors and mechanism to the allocation of cash flow rights and control rights, shows the relationship between cash flow rights and control rights, gives the bargain intervals of the entrepreneur and the venture capitalist about the allocation of cash flow rights and control rights. It is shown that the more the entrepreneur’s self-owned capital and the higher the venture capitalist’s evaluation of the venture project and the ability of the entrepreneur, the fewer cash flow rights and control rights the venture capitalist will want; the relationship between cash flow rights and control rights of the venture capitalist is complementary but not corresponding, so the result provides a theoretical explanation for Kaplan and Stromberg’s empirical researches about the disproportion between cash flow rights and control rights in venture capital firms.

Abstract:
本文以经济增加值为公司绩效的度量指标,采用面板数据模型研究企业绩效与企业垄断扩张间的关系。并应用我国沪深上市公司数据样本,对国有企业的不断扩张和企业绩效的关系进行实证。寻求国企垄断扩张的适度规模,给政策制定者提供参考。实证结果表明:国企垄断扩张使企业绩效呈显著地下降趋势。同时存在非线性的“U型”效应,即较低程度的垄断限制了企业的创新能力,导致企业绩效降低。随着垄断扩张为企业带来的超额垄断利润弥补了创新能力的不足,又使企业绩效与垄断呈现正向关系。
In this paper, we choose economic value added (EVA) as the measurement indicator of company’s performance and use the panel data model to study the relationship between the enterprise per-formance and the industry monopoly. We focus on China listing corporations covering various in-dustries and find out that there is a negative linear relation and non-linear “U” effect between the monopoly expansion of state-owned enterprises and EVA; that is to say, the monopoly decreases EVA of the company. However, when the monopoly expansion of state-owned enterprises increases to a certain transition point, EVA begins to increase, indicating that the excess monopoly profit compensates for the negative effect to enterprise. The firm performance and monopoly begin to show a positive relationship.
