El poder y el Papa. Aproximación a la filosofía política de Marsilio de Padua  [cached]

Abstract: This paper explains the meaning of Marsilius of Padua’s work, the first medieval non-clerical theory of the State. Marsilius intends to fight the pontifical doctrine called plenitudo potestatis, which he says to be the cause of the civil war in Italy in the beginning of the 14th century. Then his thought is based on the unity of the sovereignty, in opposition to dualism, characteristic of other authors who defend the secular power, as John of Paris, Ockham or Dante. Marsilius states that there are no spiritual grounds to maintain a temporal power different from the power of the human legislator and that is why the only supreme power or plenitudo potestatis does not belong to the Pope, but to the secular ruler. From that follows the complete absorption of Church by the State and the secular ruler’s authority on the whole ecclesiastical organization. The Marsilius’s thought represents an effort with no precedents to base the power on rational grounds, but it is far from the modern idea of sovereignty, as well as from liberalism and from Rousseau’s general will. Even though it was not successful in his time, it had a great influence on Anglican Reformation and English erastianism , specially on Hobbes. El trabajo expone el significado de la obra de Marsilio de Padua, la primera teoría medieval no clerical del Estado. Marsilio se propone combatir la doctrina de la plenitudo potestatis papal, porque la considera causa de la guerra civil en Italia a principios del siglo XIV. Se basa para ello en la unidad de la soberanía, frente al dualismo que caracteriza a otros defensores del poder secular, como Juan de Paris, Ockham o Dante. Sostiene que no existe fundamento espiritual para un poder diferente del poder del legislador humano y que el único poder supremo o plenitudo potestatis no corresponde al Papa sino al gobernante secular. De lo cual se sigue la completa absorción de la Iglesia por el Estado y la atribución al gobernante temporal de toda la organización eclesiástica. La filosofía marsiliana representa un esfuerzo sin precedentes por dar al poder un fundamento racional, pero está lejos de la idea moderna de soberanía, así como del liberalismo y de la voluntad general de Rousseau. No tuvo éxito en su tiempo, pero influyó en la reforma anglicana y en el erastianismo de Hobbes.

Abstract: El presente trabajo intenta profundizar en las nociones de ley de dos de los más importantes teólogos escolásticos:Tomás de Aquino y Francisco Suárez. Sabemos que el Eximio pretende dar sentido e inteligencia a las palabras del Aquinatense. Usualmente se ha marcado el voluntarismo y distancia que toma Suárez con respecto a la teologia del Maestro Angélico, motivo por el cual hemos querido bosquejar una posible continuidad entre ambos doctores de la teologia escolástica: todo a partir del análisis del concepto de imperium. This paper tries deeper into the notions of law of two of the most important scholastics: Aquinas and Suarez. We know that Suarez tries give sense and intelligence at the Aquinas' words. Usually we mark the voluntarism and the distance that Suarez takes over the Aquinas' theology; for this we wanted outline a possible continuity between the two doctors of scholastic theology: everything from the analysis of the concept of imperium.

Abstract: the existence of a hierarchy of canons of interpretation has been seen usually as guarantee to the certainty in law. but, from the point of view of legal hermeneutics, that hierarchy is an impossible task. law is not only a system of legal precepts ready to the mechanic application; it is a social interpretative practice. and this practice is not methodologically available; the understanding of the law happens through the evaluative interaction between the ratio legis and the ratio of the context. the relevance of the context implies the existence of normativity outside of the positive legal text and the possibility of a certain natural law.

The teleological interpretation suspends the conjectural causality; it decodes the purpose that precedes the human action, which is the legal norm.

Abstract: Corporate litigation is one of the methods of resolving both internal and external corporate disputes; however Company Laws all over the world establishe a number of different forums for the resolution of internal corporate disputes that occur between directors inter se, shareholders inter se, or between shareholders and directors. However the Majority rule seems to undermine the rights of the minority share holders to seek redress for wrongs committed against the company. Thus the need to protect the minority members of the company and retreat from the precipice of the Majority rule. To enhance the protection of the minority, the Supreme Court's decision in Edokpolo & Company Ltd v. Sem - Edo Wire Industries Ltd1, which added an exception to the list of exceptions to the majority rule stating that the rule in Foss v. Harbottle will not apply when the interest of justice requires it, should be included to the statutory exceptions under CAMA. Consequently, judicial authorities suggest that the law is closing gradually on the rule in Foss v. Harbottle with a demolishing hammer; therefore I would recommend in line with the tide of informed opinion, that sections like section 2992 should be reviewed appropriately to meet the changing faces of law because "the reason of law is the soul of law; ratio legis est anima legis".

Abstract: In the present study we are going to analyse the regime of the nullities in the Romanian criminal trial. This presentation will take into consideration the Criminal Procedure Code in force (adopted in 1968), the doctrine and the practice of the courts. Also, we took into consideration the new provisions of the Criminal Procedure Code which is going to enter into force in 2014. This study is focused on analysing the distinctive regime of the absolute and relative nullities and illustrating the situation in which absolute nullities do not lead ope legis to the annulment of the acts set up without respecting the requirements. In this way, we are going to analyse the situation in which in spite of absolute nullities existence, this sanction can be disregarded and the criminal trial will follow its course.

Abstract: the author reviews the history and evolution of the legal good, analyzing its relationship with inquiry regarding the legitimacy of penal norms. the origins of the concept in birnbaum's work are thus reviewed and the main dogmatic positions regarding the legal good's content are explained. consequently, both the diverse theories related to a critical or material vision of the legal good -where the legal goods' protection is a condition of legitimacy- as well the theories in which said concept is identified with the ratio legis and according to which the function of penal law is to reaffirm the validity of the infringed norm. after analyzing the theories that use new criteria and principles of legitimacy that seek to complement the role of the legal good, the article concludes attempting to show the dilemma facing the legal good theory: without independent content provided by the legislator it cannot be limited, but with independent content it rises as a countermajoritarian barrier that affects democratic principles.
