Abstract: the objective of this article is to propose a theoretical treatment for labour union representation in the public sector. drawing on the work of important authors such as pierre bourdieu, ernesto laclau, alessandro pizzorno, klaus offe, etc, a theoretical trajectory is described from the most abstract concept of political representation to a specific kind of union representation displayed in the environment of the state. methodology is based on a bibliographical review of the previously mentioned authors and reflections on field work experience. conclusions indicate the need to approach labour union representation in the public sector as a special field that requires attention to its own particular aspects, which cannot and should not be omitted.

Abstract: Este artigo reúne algumas das principais reflex es sobre as grandes mudan as que vêm ocorrendo no mundo do trabalho nas últimas décadas, destacando os seus impactos sobre a a o sindical nos países centrais. Busca-se compreender os movimentos dos sindicatos - em um dos vértices do jogo das rela es de trabalho - se reestruturando num novo contexto em que cresce a importancia das atividades de coopera o sindical internacional. Neste objetivo, demonstra-se como mudaram de escopo, ganharam corpo e influência algumas das organiza es que realizam atividades de coopera o internacional no Brasil. Entre estas organiza es s o apontadas o Solidarity Center (EUA), o SASK (Finlandia) e o Observatório Social (vinculado à CUT brasileira e com recursos da Holanda e Alemanha). Tais organiza es desenvolvem atividades de pesquisa, assessoria e apoio à forma o de quadros sindicais com recursos provenientes de outros países. Especialmente no ambito econ mico, entende-se que para a análise mais precisa das decis es tomadas nos espa os nacional e mundial pelas empresas - outro vértice das rela es de trabalho - é indispensável o acompanhamento dos movimentos dos sindicatos. This article shows main analysis about changes that have taken place within labor around the world over the last three decades. It notices the influence over the unions’ work in developed countries. It tries to understand unions’ movements - regarding one part of the labor relationship - by reorganizing themselves within a scenario in which the importance of international union cooperation activities grew. It shows organizations of international union cooperation changed by increasing their influence in Brazil. Economically speaking, in order to understand how companies take decisions at national and international level, one must know about union movements.

Abstract: A indústria automotiva cresceu nos anos 90, quando as montadoras criaram unidades fora da Grande S o Paulo em busca de trabalhadores sem tradi o na negocia o sindical, dentre outros motivos. Destaca-se aqui a cria o da Mitsubishi em Catal o (GO) e da Volkswagen em Resende (RJ). A organiza o do trabalho, o perfi socioecon mico dos trabalhadores e o movimento sindical nessas plantas s o analisados neste artigo. Embora na MMC o processo de trabalho seja tido como arcaico, a organiza o da produ o de ambas é híbrida. A maioria dos trabalhadores é da própria cidade e inclui jovens com escolaridade alta, mas sem a cultura industrial do setor automotivo e a tradi o sindical. A falta de tradi o sindical, porém, come a a se erodir: em Resende, o sindicato se mostra comprometido com seus representados: participa de acordo coletivo e mantém comiss o de fábrica; em Catal o, ao final de 2004, foi criado um sindicato dos trabalhadores metalúrgicos, que também iniciou uma trajetória de luta pelos interesses de sua base. Motor industry in Brazil has increased in the 90s, when companies set up plants outside of S o Paulo in search for workers with no experience in trade union negotiations, among others motives. In this article we focus on the cases of Mitsubishi in Catal o (state of Goiás) and Volkswagen in Resende (Rio de Janeiro), by analyzing the organization of work, workers’ socioeconomic profiles and union movement in these plants. Although working conditions at MMC are seen as outmoded, both plants maintain a hybrid organization. A good deal of workers comes from Catal o and includes young highly educated males lacking, however, the industrial culture peculiar to the automotive sector as well as tradition in union trading. The lack of labor union tradition, however, starts to erode. In Resende the union seems to be committed to the workers it represents: it takes part in collective bargaining and keeps a factory committee. In Catal o a labor union was created in late 2004 and began to fight for the interests of its base. Keywords: Motor industry. Workers. Syndicate. Catal o. Resende.

Abstract: Critique of trade union freedom The article begins of the protective character of Labor Law and of the study of trade union freedom as an instrument of compensatory inequality, to analyze critically the protection of this right in the Committee of Trade Union Freedom. Then, it develops causes of the current crisis of trade unionism and the possibility of atrade union self-reform and of an International Court of Trade Union Freedom. Finally, the article presents some strategies for overcoming the crisis of trade unionism El artículo parte del carácter protector del derecho del trabajo y del estudio de la libertad sindical como instrumento de desigualdad compensatoria, para analizar críticamente la protección de este derecho en el Comité de Libertad Sindical. Seguidamente, se desarrollan las causas de la actual crisis del sindicalismo y la posibilidad de una autorreforma sindical y de un Tribunal Internacional de la Libertad Sindical. The Impact of Labor Contract and Labor Union on Social Security Right  [PDF]

Abstract: Based on ten cities’ workers data about the employment situation of the worker in 2010, the paper analyzes the influence of labor contract and labor union on social security rights by using binary logistic regression model. The study found that: 1) labor contract and labor union contribute to the acquisition of the workers’ social security right, and the promotion of labor contract is greater than that of labor union; 2) the impact of labor contract and labor union on different types of social insurance is also different, which is more reflected in the unemployment insurance and basic medical insurance, while less reflected in the work injury insurance.

Abstract: O artigo analisa a rela o entre a ideologia neoliberal e o sindicalismo participacionista, mais precisamente o da For a Sindical, como condi o necessária à compreens o da mudan a na orienta o do Sindicato dos Metalúrgicos de Volta Redonda a partir de 1992, quando sua dire o passou a atuar vinculada a essa Central, opondo-se, desde ent o, à combatividade operária que se fez presente entre aqueles trabalhadores durante o período de 1983 a 1991. Para tanto, s o discutidos tanto os pressupostos neoliberais acerca do sindicalismo quanto os elementos do ideário da For a Sindical que se inserem na vis o de mundo própria desse projeto. This text analyses the relation between the neoliberal system and the participative union, more precisely the For a Sindical, as a necessary condition for the understanding of the change in the idealistic orientation of the Metallurgic Union of Volta Redonda since1992, when its command began to act in accordance with the For a Sindical against its previous labor combativeness present among those workers from 1983 to 1991. In this context, not only the neoliberal reasons for the unionism but also the elements of the For a Sindical ideas which belong to the world vision of this project are discussed. Keywords: Unionism. Representaciones humorísticas en el principal diario argentino ante el "resurgimiento" sindical Humorous representation in Argentina′s leading newspaper in view of the "resurgence" of the union actor

Abstract: En este artículo nos proponemos analizar el funcionamiento del humor gráfico cuando se lo incluye en las coberturas periodísticas que abordan los temas de conflictividad sindical en el período 2004-2007. Esta época, bajo el gobierno de Néstor Kirchner, coincidió con un "resurgimiento" del actor sindical en la escena política nacional, a partir de la dinamización de la negociación colectiva, aumento de puestos laborales, incremento de luchas por aumentos salariales y acuerdos tripartitos entre las principales organizaciones sindicales y empresariales. El estudio se concentra en el caso de Clarín, teniendo en cuenta el lugar de privilegio que, en tanto actor político y económico, tiene este medio en la escena nacional. Este diario forma parte y se constituye en piedra angular del holding empresarial de nombre homónimo Grupo Clarin, principal grupo multimedial nacional con control de diarios y revistas, licencias de televisión, Internet, emisoras radiales y productoras, entre otras. La idea de analizar las representaciones mediáticas sobre la temática sindical focalizando, en este caso, en el funcionamiento del humor (análisis de chistes y caricaturas) surge de la sospecha de que el humor gráfico político funciona, como se ala Mazzei (1997:88) como un recurso ante el cual "el receptor relaja su guardia y acepta -risue amente- muchas de las premisas implícitas en el mensaje de la nota". La pregunta que guía este estudio es, entonces, cómo el humor funciona modalizando o potenciando las narrativas mediáticas, construyendo y fortaleciendo ciertas nociones del sentido común en torno a cuestiones históricas del sindicalismo nacional. The aim of the following article is to analyse the purpose of graphic humour when used in political journalism for the coverage of conflicts related to trade unions in the period 2004-2007. During Kirchner's government trade unions became a central political and social actor favoured by collective bargaining, a gradual recovery of employment and struggles for salary increments as well as tripartite agreements between government, industry and traditional union organizations. The study focuses on the case of Clarín, taking into account the place of privilege both as a political and economic actor in the national scene. Abstract: The phenomena of the decline in the union density have led to various interpretations, which can be grouped into two main currents. The first one attributes the causes of the decline in affiliation to the contextual factors of the unions, linked to economic and political transformations. The second one, emphasizes the internal factors of the organized labor, linked to organizational forms of union. Among the first were reported changes related to the economic structure, the individual characteristics of the workers and the social and labor factors as determinants of affiliation. In this context, the objective of this paper is to analyze the union density in its linkage with different contextual variables among Argentine workers, establishing the extent to which they approach to the traditional assumptions about the crisis of union representation. El fenómeno de la caída de la tasa de afiliación sindical ha suscitado diversas interpretaciones, las cuales pueden agruparse en dos grandes corrientes. La primera de ellas atribuye las causas de la baja en la afiliación a los factores contextuales de las organizaciones sindicales, vinculadas a las transformaciones económicas y políticas. La segunda pone la impronta en los factores internos al movimiento obrero organizado, vinculado a formas organizativas del sindicato. Entre los primeros se han se alado los cambios relativos a la estructura económica, las características individuales de los trabajadores y los factores sociolaborales como determinantes de la afiliación. En este contexto, el objetivo del presente artículo es analizar la afiliación sindical en su vinculación con diferentes variables de carácter contextual entre los trabajadores argentinos, estableciendo en qué medida se acercan a las hipótesis tradicionales sobre la crisis de representación sindical.

Abstract: El presente estudio efectúa un análisis sistemático y crítico de los mecanismos de resguardo de la libertad sindical contenidos en el Código del Trabajo y, en particular, del procedimiento judicial de tutela ante las infracciones a este derecho fundamental, vale decir, frente a las prácticas desleales o antisindicales. Para estos efectos, se consideran las normas incorporadas a nuestro ordenamiento jurídico por la Ley No 19.759 tendientes a reforzar el respeto y promover el ejercicio de la libertad sindical, en concordancia con las normas y principios de los Convenios No 87 y No 98 de la OIT, como, a su vez, las recientes innovaciones introducidas por la Ley No 20.087 que modifica el procedimiento laboral, entre otros aspectos, en lo relativo a la protección de esta garantía constitucional. De esta forma se desea poner de manifiesto el avance experimentado por la legislación laboral para asegurar el pleno y eficaz ejercicio de los derechos fundamentales de los trabajadores en el ámbito de la empresa. This paper makes a systematic and critical review of the mechanisms contained in the Chilean Labour Code aimed at protecting labour unions’ freedom. In particular the paper refers to the judicial procedure created for the protection against violations of this fundamental freedom, involving unfair or anti-union practices. This article considers provisions introduced by Law No 19.759 with the purposes of reinforcing respect and promotion of unions’ freedom and of making these provisions compatible with the norms and principles of the Conventions No87 and No98 of the International Labour Organization (ILO). It also reviews the recent innovations introduced by Law No 20.087 that modifies the labour judicial procedure, among other matters, regarding the protection of this constitutional guarantee. The author exposes the improvements that Chilean labour law has undergone to ensure the full and efficient enjoyment of the workers’ fundamental rights within their companies.
